Political Asylee applying for i-131

Hello,
I just wanted to discuss my situation , anyinput will be greatly appreciated.

I was granted political asylum in January 2006 (my father’s application for the whole family) and we filed for I-485 in January 2007. We live in Los Angeles, CA if that means anything.

I received an Interview for Adjustment of Status (Form G56) on August 10th 2011 but it was postponed twice (august 22nd to September 22nd and September 22nd to “wait until further notice”), they sent us back when we got there saying that they were still waiting on a document? (I’m assuming it’s the name clearance from FBI) but why would they invite us if they hadn't got it cleared first?

My question is that I am planning on traveling to the Caribbean for Medical School on December 28th 2011. I applied for the Refugee Travel Document, which was received by USCIS on October 26th. I have not received an appointment for biometrics yet

What should I do as of now?
1) Expedite request for AOS? What happens if I get an interview while I am overseas??
2) Expedite request for Refugee Travel Document?
3) Should I just walk-in for biometrics instead of waiting for an appointment?

Hmm, it's an interesting case. You cannot walk in to have your biometrics taken until you receive a biometrics notice. The staff of the application support center need to scan that notice to input your fingerprints and picture into the USCIS system.

If you are scheduled for a green card interview while you are overseas, you will probably be screwed.

Your best bet is probably to try expediting your I-131 processing. Call the USCIS and tell them you suspect that your biometrics notice might have gotten lost in the mail. I did it once and they told me on the phone the date for which my appointment was originally scheduled and said they would mail me a copy of the notice right away.

I received my biometrics appointment notice last week for December 5th, so that's definitely a relief. When I get my refugee travel document, I will have my parents mail it to me so I can travel back to the US.

I also scheduled an InfoPass appointment on the 6th to find out what my options are regarding postponing my AOS interview if I am overseas.

Do you have an idea if they do this? Or do I pretty much have to travel back to make it to my original appointment date?
 
why would u postpone

your GC interview....Just come back and do it...I think you may file a lawsuit that many people on this forum did, do some research. Those people had their green card application delayed for some reason and were successfully getting their GC application resumed after fillin that lawsuit.

You filed your I-485 in January 2007 and it it almost 2012. Why is it taking so long (5 years)?

What is the cause of the delay?
 
@algorithm -- well as i said earlier, they invited me for an AOS interview twice, and both times they postponed it to a later date saying that they were waiting on some document? They did not really give me any specifics. But what i don't understand is that why would they invite me for an interview if they did not receive the documents in the first place??

@Mauricio22 -- Thanks for your input, I'll definitely look up info regarding lawsuits.

You said your first intervew was on August 22, 2011 and you filed your GC on January 2007. It took them almost 4 years and 7 months to send you a notice for the first interview. Why did you wait 4 years and 7 months?

You should not ask them to postpone your interview because this will not help you in the district court if you decide to file a lawsuit against them.

Also, I don't recommend you travel because you do not know what they are planning to do on your case (approval, denial, termination, God only knows)

Remember that you do not have a due process if you are outside the country. Consult a lawyer before traveling.
