Police Clearance Certificate (CP)

Good day Everybody

My Employment based visa is being processed at the NVC ( Packet III has been Generated)and is scheduled to
be moved to the chennai consulate at a later date. I have a question on
Police clearance certificate.

We(Me and my Husband) are living in USA for past 3 years.We dont have any criminal records in USA .

1.Do we need a police clearance certificate from USA(i.e from the nearest Indian Consulate) before I leave USA for the Interview

or

2.Is the Police certificate from India and the Regional Passport office PCC from India is enough?

Please let us know what should we do

You need PCC from the Indian Consulate in the US. It takes about 35 to 45 days after you apply.

My packet III has been generated in the NVC last week and has been sent to my Attorney last week.

Does my attorney need this for filing (the DS230 (I) -BioGraphical Form and DS-230(II) Sworn Statement) packet to the NVC for review?

or

is it enough if we take it at the time of interview to India.

Packet 3...

consists of the biographical form or DS230 I which you will need to fill and sign and send back to the NVC. The DS 230 II is part of the packet 4 and will be sent by the consulate.;)

When you send back the packet 3 to NVC you (your attorney)
need to send back only those forms specifically requested by
the NVC in your packet 3.

Normally in the case of consulates in India it consists of
DS 230 Part I . The Sworn statement (Part II) need not be sent at this time. You carry it to the Interview.

PCC is also not required to be sent along with Packet 3 with
few exceptions ( Ex: If you belong to consulates in Canada they
require you to send the PCC with Packet 3). If you are attending
interview in India, you will carry it with you for the interview.

The case specific instructions in the packet 3 supercede what I
said above. Follow the instructions.

Do I need this?
When should I get this from IRS.

2.What is Form I-134 Affidavit of Support .
My husband is working here in USA.Does he need this

3.Does my husband also needs a notarized employment letter from his employer

4.What are the Other documents I need to prepare for my husband for the interview

5.I am planing to get the "free" tax transcripts from the IRS on Monday.
Me and my husband filed tax together.My husband work in CT and I work in FL.
Does my husband need to be there when I go and get the Tax transcript or will IRS will give me the Tax transcript since we filed together..any idea???

{Sailing permit also called Form 9003 is similar to IT Clearance
certificate. But the Dept. of State has done away with this
requirement. Currently you need not carry this document}

2.What is Form I-134 Affidavit of Support .
My husband is working here in USA.Does he need this

{I am not too clear about this. Normally non working spouses
need the affidavit of support from the main applicant. In your
case since your husband is also working, technically you need
not give an affidavit saying that you would support him in US.

Await other's feed back on this item. If there is still a doubt,
carry this document by downloading from the web and getting
it notarized after you fill it. }

{No. But ask him to carry all his H1 approvals, few pay stubs
to show if asked for}

{I ordered for the tax transcripts on phone. I do not know
whether the field office would require both the parties to
the filing to come together. I am assuming they would not! }

You don't need a this anymore

No but it is always good to carry one. All you have to do is fill it and get it notarized.

3.Does my husband also needs a notarized employment letter from his employer

No but he can carry a standard letter of employment from his company with all the documents such as pay stubs, H1 etc. Carry all the documents and the kitchen sink.

IRS will give it to you but will ask you your husbands birthdate and how many deductions you had for the tax year u want the transcript. If you don't know don;t worry they will ask you other questions till you satisfy their curiousity
