POE uses AP rather than Valid H4

Hi guys,

My wife returned back to US after a short trip. Even though she had a valid H4 stamp in the passport the officer used her AP on I-94.

How would this effect our status? Can we file for H1/H4 extension or transfer if needed next year.

Can input is really appreciated.

How did the officer "use" her AP? Did your wife present AP to the officer?
 
your spouse was a victim of POE intimidation. You should file a complaint to the BCIS office. If there is a H4 stamp, she should not have shown the AP.
However there is no harm, only thing is you have to be diligent in getting the new AP (apply 4-6 months before expiry) here afterwards, to cover emergencies.

Yes, the officer asked for documentation & I guess she should have just showed her Valid H4.

Is it possible to still continue to use our H1/H4 status for future travel. Can I use apply for H extension/transfer. I really want to maintain my H status.
