It will take her forever to obtain a GC thru you, esp while you are on a GC status. The best way is if she could come to US on her own. You guys can try to get to know each other and later get married. You can apply I-130 for her and later when you become a US citizen, you can apply I-485 (AOS paperwork) for her.

tnx alot for your advise:)

if we married and I apply I-130 for her , how many time and days can outside the USA ??
can I came back to US every 5 month or 6 month when i apply for her?is it check or not?

tnx:(

Hey littlespace...I feel you. But atlanta_brother is right; it will take you forever to get together with your girlfriend. The reason I am saying that is that I went through the same pain. You are little less than two years away from your USC. Don't be fool and jeopardize that. If you are going to be out of the country for months, you might not succeed to get your USC. After you get your USC, you’ll be able to get her in pretty fast. As far as your marriage goes, then you can marry her wherever and whenever you want, but you will not be able to get a green card in the next few years. The best bet for you is to either get her in some kind of school here, where she can continue with her nursing degree or get her to pass the NECLEX (nursing exam) and have her come here on a H1B visa (a work visa), sponsored by a hospital here. Keep in mind that US desperately needs nurses.

By the way, man, no offence, but you've got to do better with English if you want to get your USC with no problems.
Also, I would advise you to look up the form N-400 and acknowledge yourself with the citizenship eligibility requirements. If you are out of the US too much, then you are screwed.
Good luck.

hi zuzkin, tnx for your advise,

i have some questions:
1-after I marry with my girlfriend , can she apply for RN and CGFNS or Lottery or student visa or something and come to USA?

2-if she apply for RN and CGFNS or .... , can I apply for her from myself concurrently?

If you marry your girlfirend, she will most likely be unable to apply for any of the programs you mentioned. The reason is that she will automatically have an immigrant intent once she marries you. Also, when she goes to the US embassy to request a non-immigrant visa like H1 or F1, she'll have to disclose that she is married with an US GC. Tha alone is a solid ground to deny her a visa request.
I don't see any problem with you helping her applying for any of those programs. You'll probabily need to contact an RN program director or a hospital to find out more information.

tnx guys ,
I decide to marry with my girlfriend and after 1 years apply for Citizenship , I read in documents that I need 30 months (2.5 years) for physical presence in 5 years of permanent resident in USA, i think can got my citizenship for 2 years letter, any suggest for my idea?

Tourist Visa future spouse of GC holder

Hi, I'm in the U.S and I'm gonna start a process to get my
U.S citizenship because I have my GC for more than 7 years..
The problem is my fiancé is in Brazil and they say the U.S citizenship
is a very long process and I really don't wanna be a long time away from him...we have been together for 2 years and we want to get married and live our life in the U.S

My question is:

1. Can he come to the U.S with a tourist visa and we get married while I'm still a GC holder so he can stay here legally while my citizenship doesn't come out? will he be able to work/study?

2. If it's not possible what would be the best way that he can come legally and stay with me so we don't have to be seperated?

PS: we don't really care how long it would take for him to get his papers if we get married while I'm a greencard holder. What we most care about is not being separated for too long from each other as long as he is legal and authorized to work/study

Thanks!!

1. I would guess that it would be tough to get a tourist visa (which has non-immigrant intent), as your fiance would have to disclose on the application that he is engaged to a permanent resident. He would not be able to work or study as an out-of-status alien who entered on a tourist visa until you become a citizen and apply for AOS for him. A student visa would allow him to work on campus and study, but he needs to have non-immigrant intent to get the visa.
2. Your best bet is to apply for citizenship as soon as possible and go the fiance visa route. On average, citizenship applications are taking 6 months to process. I'm not sure what the K-1 timeline currently is.

Another option is for you to apply for and receive citizenship and then move to his country and get married and apply for a spousal visa for him from there, so you aren't separated for a long time.

Lastly, if your fiance qualifies for an H-1B visa, that would probably be the fastest way for him to move here, and it allows immigrant intent.

Good luck!
