pls pls help me!! about A# pls....!

I got married to a US citizen, he sent the I-130 to Laguna Niguel and then I found out I could have applied for Adjustment of Status together with the I-130.

I got the receipt notice letter for the I-130 from Laguna Niguel and I sent Laguna Niguel a letter asking them to send my I-130 to the local office in Santa Ana. At the same time I sent all my Adjustment of status forms to the Santa Ana office with a copy of everything that was sent to Laguna Niguel.

My Question is- did I do o.k.? or should have I waited until I got a notice that my I-130 was transferred to Santa Ana office before sending all the Adjustment of status forms to Santa Ana?

And the other issue is- I want to go to a community college in the spring- so I have until January 10th to apply, but they asked for my A#. Which I don't have. There is no A# on the I-130 receipt I got.

I went today to the local office in Santa Ana and the officer there told me I will only get an A# once my I-485 is approved (within 8 months) or when I get my EAD (which takes 90 days)... I do not have that much time!! I asked him maybe he or anybody can sign a letter stating that I'm applying for AOS and he said there is nothing I can do. I told him that I read online that sometimes immigration put an A# on the back of the cheques after they cash them... is that true? will Santa Ana office wait for my I-130 to be transferred from Laguna Niguel and only then cash my cheques or will the cash it now?

In conclusion, the Santa Ana office weren't very helpful....

I called immigration again and the supervisor on the phone told me I should write a letter to USCIS attention: district director

And describing my problem...

I thought if I won't find an A# on my cheques like within a month I'll try applying for emergency AP hoping they'll aprove it and write an A# on it...

If you apply for your EAD you will see your A#. But, this does not mean that you are a permanent resident (the term you used, "permanent immigrant" is incorrect) Your school most probably wants you to be a permanent resident with an A#, not just a person with a pending case and an A#. I went through the exact same thing when my I-485 was pending. If you don't want to pay triple the tuition fees, then you'll have to wait until you get your green card, also known as permanent resident status, and then give them your A#.
 
There is a word "resident for tuition purpose" or something, which is different from "permanent resident" as an immigrant with green card. I think different states have different rules...in some, you may be "resident for tuition" if you have valid H-4, and live in this state more than 12 months, for example...
 
A# should be on the back of your check (cleared) and also on the receipt for I-485 form...

Even schools within the same state have different rules. Some want you to prove residence of the state, others want you to prove residence of the USA, which are completely different. If they are asking for an A# it seems they want proof residence of the United States (i.e. Permanent Resident Status)

You need to clarify very specifically with your school what they require. The verbiage can get very tricky, so you need to be very precise.
1) Just an A#? Is it ok, if you are not a permanent resident and do not have a green card?
2) An A# and proof of state residence? Is it ok, if you are not a permanent resident and do not have a green card?
3) An A# and proof of legal US resident status? Is it ok, if you are not a permanent resident and do not have a green card?
4) An A# and proof of permanent resident status

Note: 3 and 4 are very different, even though the terms seem very similar. In #3 all you'll need is a H1B or an F1 or TN or some kind of a visa. In #4 you'll need a green card, or an I-551 stamp in your passport and nothing else.

I don't mind paying out of state tuition; I just want to be able to go to school. I cannot get an F1 since I'm applying for a green card. So what's the way for me to go to school? wait another year?

I don't want to ask the school too many questions, I already asked too much...

The school I'm applying for has an option on the application list called "permanent immigrant" and I have to say my A# and the issue date. the admissions office will allow me to go to school as long as I have an A# ... However the national service center says I won't get a receipt notice from Santa Ana or A# on my cheques... What should I do? Help...
 
You Do Not Need To Be A Perm. Res. To Attend Community College.what Visa Do U Currently Have.do U Have A D/l.also Do Make An Apt. To See The Dean And He May Wave For I Year Thje Restriction.take Supporting Docs Or Even Your Spouse.

If you want to go to school, you MUST find out what are their requirements. You have to go there and ask more questions.
Schools have different rules: I fully agree with curiousGeorge. I also agree with Kay Kay: you should be able to go to school if you are legally present in USA, other thing is tuition fee which may be higher 1st year.... If the particular enrollment form you found is not good for you, there should be other forms available...
People on this forum help you a lot with all info they have, but no one can go there for you, you should do it yourself..:) I see you have a lot of energy from the number of your posts on same topic...
 
I am now on a B-2 visa... but waiting for my I-485...

I didn't send the I-130 and I-485 together... (too bad) so all I have now is the RN for the I-130.

I don't mind paying out of state tuition I just want to know I can be addmitted.. so for the first year I'll pay more.

I'm going to the school today.. (just me) wish me good luck:)

I'll tell you how it was....:)

PS: does anyone know how long it takes the Santa Ana office to send FP notice?
