Hi All,
I am new to this forum ans also to the procedure related to H1 & h4 visa. This place seems to be my last resort for my tricky problem. I have a couple of concerns & some doubts.

My situation:-
I came to US with my husband in Feb 2003 on an f2 visa( student dependent visa). I was then hired by one of the consulting firms which applied for my H1 visa. I received a letter from INS stating that the petition for nonimmigrant worker was approved. It stated the validity duration , class - H1b and it also had an I94 attached with it which I was supposed to attached it wioth my passport. The letter said it was case tye - I129.

Now my doubt is , what is this document? & what does this signify? And if this is an H1B approval then will I now be on H1 status or am I still on f2 visa?

Based on this I received my SSN. Although I have not yet had any project to work on. My husband finished his studies and has received a similar form described above as a response for his H1B approval notice.

I now want to change my status to H4.
will my not having any paystubs be a problem in getting H4 visa?
Pls help me guys.. I am in a deep deep trouble.
thanks

My suspicion is unless you use the H1 Visa your status is what was before that. I could be wrong. Please run seacrhec on the forums as I am sure you will find answers to it.

------ your status got changed from F2 to H1, and you are on H1 status and can start working as you got I-94 attached with H1 approval notice
The letter said it was case tye - I129.

Now my doubt is , what is this document? & what does this signify?
--- it is H1 approval notice, I dont know how you Directly got it from USCIS, H1 is filed by employer or his Lawyer and Employer or lawyer gets the H1 approval notice and then they give you
And if this is an H1B approval then will I now be on H1 status or am I still on f2 visa?

--- you are on H1 status
Based on this I received my SSN. Although I have not yet had any project to work on.
My husband finished his studies and has received a similar form described above as a response for his H1B approval notice.

I now want to change my status to H4.
---- if your husband also applied H1B through some employer and got it approved then again you need to file Change of status(COS) from H1 to H4, take the help of lawyer becase i dont know what is start date on YOUR H1B, if you did not work for H1 employer(as you posted you dont have any Paystub) then USCIS may deny the petition and say you were out of status. go to good lawyer

will my not having any paystubs be a problem in getting H4 visa?
---- geting H1 to H4 status from USCIS and H4 Visa stamp from US consulateare diffrent matters
Pls help me guys.. I am in a deep deep trouble.
