Hi all, me and my wife was married on Feb. 2004 in the US. She was a Canadian citizen and she entered the state to stay with me. Earlier this year (Jan) she left and went to china to visit her family. When she came back the custom told her that she was overstay and denied her entry. We were so upset b/c when she entered the state, she was never required to file any entry record since she is a canadian citizen and we totally don't know anything about this overstay situation. Because of this, she was handcuffed and put into some kind of detention room for one night until the next flight to china is available.
I didn't file the pentition for her after we married b/c I was still a student a the time and we don't know how to file the affidavit of financial support since I didn't have any income at the time. Anyway, this whole thing is messed up. After the accident, I filed the I-130 and I just wonder how long it will take to get it approved by the USCIS? They cleared my check in the middle of April this year and I really want to know the est. time for them to process this kind of thing. Is she able to come back after this even the I-130 get approved? I am so worried. If we can't stay togther, I will stay with her in Canada even thou I have a good job here now. I really miss her :*(
