Pls Help!!! 485, AP Issue!!! URGENT

Hi Guys,
I have a very tough decision to make regd my I485.

1. My visa H1 and wife\'s H4 is expiring on Nov. 1, 2001. Our Visas has been extended till 2003 but we haven\'t stamped it yet.

2. I got my I-140 (VSC) approval on 09/10/01.

3. My wife is scheduled to travel to India on 09/22/01. (I will join her on Nov 10, 2001. we had decided to get the visa stamped at Mumbai).

Now, my lawyer is saying that we can file for I-485 on 09/13/01 by fedex and hope that we will get an \'A\' number and with this \'A\' number file for AP in philadelphia which we might get it by 09/21/01.

The whole thing looks very tight.
Q1. If I do as lawyer says but by chance we don\'t get AP for my wife before 09/22/01 then can she still leave the country? if yes then what are the drawbacks?

Q2. Can we apply for 485 and let my wife leave the country without receipt.
I can carry the receipt with me when I go in Nov (if I get it) and then get the visa stamped at mumbai and comeback.

Q3. Should I just not file the 485 and wait till we both come back from India?

Q4. Do you have any other alternative or solution.

Thanks for taking time...Please let me know as soon as possible so that I can make the decision.

Take a decision

To Continue you process to get GC ASAP or you want to go to INDIA.
I happened to goto INDIA and came back on JULY 2001, and then applied for AOS(Adjustment of Status).

My Friend,

Take one of these decision.
1. I feel at this time, do not plan to go to INDIA unless a
    genuine reason or Emergency
2. Do not apply for I-485, Enjoy in INDIA, Come back ASAP.
3. Postpone your trip, Get AP as digi says then you can travel without any problems.
4. Note If you apply for I-485 and then wait for AP, it is taking
   3 months to get AP ( Advance Parole ).
