I have applied for I-140 in Dec. My H1B expires in April.
1. what are my chances of getting I-140 by april.
2. If I-140 doesn\'t get approved by April , and I have to leave US will I-140 processing continue ?
3. Is there any way I can extend my stay here ?
4. Do you need to be in US to apply for I-485 ? If so can I come back after
getting EAD ?

You can extend you H1B for

You can extend you H1B for 1 year......every year till ur 485 is approved

Please consult a good lawyer.....otherwise you will screw up ur case

My understanding is that you can extend H1B for one year every year only if you have filed I485...

A law which was signed by Clinton last Dec 2000, allows H1B visa holder to be extended beyond 6 yrs. if you have filed I140, so just
ask your lawyer to have it filed. Don\'t worry we are of the same case.

If you priority date is 365 days prior to the date of your completion of H-1 , you can apply for the extension. This means that if your labor is filed before the April 2001, then you should be fine. Consult your attorney about it.
     If your labor is after April, then you have to go out of country but your processing will continue if your employer wishes to continue. In that unfortunate event, you cannot file I-485 (if your I-140 does not come by April which is very unlikely unless some RFE comes for you) and may be you have to apply for CP and enter into the country with green card.
