Hi,

I am working for company A with H1B visa. Can company B file for my green card? If so do i need H1 from Company B also? At what stage i need to join company B? Is there any issues with this? Please anybody suggest me on this.

A: Yes

A: Not unless you want to work for Company B before you get EAD or GC approval.

Q: At what stage i need to join company B?

A: When the GC is approved

Q: Is there any issues with this?

A: AC21 applicability is somewhat a question if you never work for the sponsoring employer.

Thank You very much Jim! This is badly needed suggestion for me and clarifies so many things.

I have some more questions, at the time of applying for I-140 and 485 i need to give INS my latest resume, pay stubs and W2 forms etc., and all of these will be from Company A. Will this be a problem?

My job title and field also should be similar at the time of applying 485?
