Good morning.

I have a situation and would like to get views from this forums as what needs to be done.

Myself and my husband applied for 140/485 in Sep 2004 through VSC. I am the primary applicant for this(This is a substitute labor). But my 140 got rejected in Dec 2005 due to company financials. I opened MTR and am still waiting for the results.

Mean while my husband's Labor got approved in Aug 2005 and we applied another 485 in Sep 2005 through TSC based on his application. His 140 is approved and we have EAD through his application.

Now the question is - Can I change the job using EAD through my husband's application. Will my rejected 140 from the first case will have any influence on me?

Please suggest.

I think you can change. Please note that your Alien Number (A#) is the key. Currently you will have one A# with your I-485 receipt, whereas your husband will have and must have the exact A# both on his I-140 and I-485. The only problem I see is that if your MTR is accepted and I-140 is approved, you may have two A#s. My entire I-485 approval got into a sticky-wicket because of dual A# issue. Don't worry. The worse that will happen is a local office transfer for interview and some 'longer' delay. That is much better than what your current worry is: Am I in state and can I change jobs? Well, I think you can.

Thanks a lot for your response.

In our case, we have only one A# for both the cases. Because when we applied through my husban'd labor, his lawyer suggested to give reference to the old one. So in our application we mentioned that another 485 is applied through me. Due to that reason TSC issued the same A#.

Will there be any issue?

Fantastic!!! I think your lawyer is a very smart (wo)man. That's the way to go. You should just be fine.
