Got PR on july/4/1999

Arrived to USA on july/4/1999 stayed till august/21/1999 and left usa
taking reentry permit and came back to usa on sep/9/2001 stayed till nov/06/2001
came back to usa on oct/21/2002 stayed till nov/03/2002
came back to usa on dec/24/2002 stayed till jun/05/2003
came back on may/02/2004 staying till current date.
You guys want me to apply under 5yrs rule now(in that case i have to prove i did not break the continue residence bet june/2003 to may 2004, the proof i have for this 2003 and 2004 tax filing, bank statements, Dean certificate doing medical school, i dont have any immediate family member except my brothers and sisters) or wait till May 03 so i can try under both 5yrs and 4year 1 day rule or wait till Feb 2009.

I have another q, if i fail to prove my continue residence, can i able to withdraw my application at the time of interview. so i can apply immediately.

Thanks a lot again, u guys are really helpful.

Your case is not clear cut, and rulings of continuous residence and establishing residence can be very subjective. Apply with the 4 year 1 day rule and see what happens. If rejected, you'll be able to reapply later at the new 5 year mark (May 2009 minus 90 days).

One possibility if you apply at the 4 year + 1 day mark is that if you are close to the 5 year mark at the time of the interview, and they say you don't have enough continuous residence, ask them to put the case on hold and reopen it with a new interview at a later date when you would have satisfied the requirement. That is so you don't have pay the fee again and redo everything. They did something like that for another poster, telling them the case will be reopened in December. Of course, it is up to their discretion whether they will agree to do that or reject you outright.

jack i have another q about withdraw of application at the interview, whats your thought on that.

If you withdraw you'll have to reapply from scratch again. Why bother? If rejected for insufficient continuous residence, the rejection won't be held against you when you reapply. If you're going to ask for anything at the interview, ask if they can put the case on hold and reopen it later.

Jack, i have one more q, how much chances are there if i try to convince IO with respect to continue residence bt june 2003 to may 2004, with my tax filing of 2003,2004,deans letter, bankstatement.

Thanks again

Its impossible to say with any degree of certainty. One big plus is that you were studying overseas rather than engaging in foreign employment. Beyond that, its really down to whether you get a friendly IO or one that wants to be a pita. If you don't mind risking a few $$$, apply under the 5yr rule now, and you can always reapply later with no penalty.

Thanks Boatbod. what kind of documents can i carry from my sister, to the interview. on the basis of immediately family.

Don't know if anything from a sibling will be much help. Spouses, parents and children are more useful imho.

Thanks Boatbod, i will apply ASAP, hoping everything goes well, in the meanwhile if u find any informative things pertaining to my case, pls pm me.

Thanks once again.
