Please suggest - Critical situation

Hi,

I finished Bachelor's Degree in Dec 2004 and I was working as a Software Design Engineer in one of the biggest IT company in the world while in O.P.T. I didn't get H1B since the quota was over on Aug 10, 2005 and my application reached to INS on Aug 12. My O.P.T expired on Jan 9, 2006, so I had to leave my job. I planned to take H4 status until H1B becomes available. I gave all the necessary documentations to apply for H4 to my lawyer in Dec 22, 2005. But she told me yesterday that she sent my application along with another person's and there was a problem with the fees with that application and INS returned the whole package to correct the amount without looking at my application which was in the bottom. Now my grace period of 60 days ends in March 10. My lawyer already resent my application. I expect to get the receipt of notice in a week or so.

My question is, will I be in-status after my grace period ends if I have the receipt only for H4? Or I have to have the approval? What should I do in the situation where in case I don't receive the receipt again before the end of grace period?

If you have H4 receipt notice (not attorney's word) before your grace period yu are OK.

Thank you very much for your advice, great_guru. I really appreciate it. I will wait for the receipt until the end of February. If I still don't get it, I will have to think of something else.
