I've read one case where 140 was revoked before 180 days from RD of 485. The beneficiary still went ahead and submitted AC-21 documents and his 485 was eventually approved.

I suggest you dont give up hope and hire a good attorney. Good Luck.
 
My employer yet to revoke my I-140

Hello List,

I am portable to use AC21 and joining with new employer. Obviously my old employer is not happy about it and he would definitely go ahead and revoke my I-140. I spoke with my new employer attorney and they promised me that they are going to help me in every stage if there is any denial or RFE from INS. So I am all set to take the risk. I will post my case details here as it proceeds.

Hi,
I am currently with a subcontracting firm who did my 485 filing. At the time of filing they made me sign a contract " not intend to leave for 2 years from day 485 is approved" , prior to my filing of 485. I had no choice but to sign that contract and go with 485 filing. As of yesturday, I informed them that I have accepted an offer and now they are mentally harrassing me that they would revoke my 140 and 485 and i would have to go back to india. My new company is all set to support me for my case. So I think I am all set to take the risk. Legally they cannot revoke 140. But if they have to inform INS about me,. i cannot do anything to stop them. AC21 is there for a reason. I will keep you posted how my case proceeds. Its really sad,. indian company exploit their own country people and are very rude. Lets see what happens to my case. God Knows ..

I-485 - filing June 2003
EAD ist - August 2003
EAD 2nd - August 2004
I-140 - August 2003

if your I140 is approved and I485 pending 180+ days, then u can surely switch to a similar job without worrying what your sponsoring company can do. even if u receive a NOID/denial, u will still be successful in the end in getting ur GC.

btw, i agree with you that most, (though not all) of the indian companies screw their employees by all means .... :mad:
 
Exploited by Employer for Green Card.

I am a living example of exploitation of an NJ based "dalal" company . The employer even tried to put a case on me by putting false allegations on me. He sent a letter from his attorney falsely claiming that i had given his Employee Policy Manual to the new company I joined. I was almost laid off by him if I wouldn't have found a project on my own when my labor was in the process. The employer in my case is not Desi. He is from middle east country but he is a citizen . He was raised here. He didn't pay me for 2 paystubs . The amount of mental torture I have undergone can't be explained by him. You can read my case details on this forum. I have spent 4 years in this country and now I feel frustrated to see the level of exploitation in this country.

report him to every federal agency and get your lawyer to fight back.
then he's probably made some mistakes in the law.

provided he didnt pay you and you have signed no agreement saying he can deduct for 485 fees etc,you cna recover and you should recover so the bhadvas stop their business esp NJ based dallas.

fight him fully also there are some pro bono lawyers who will fightr for free,. first step tell him to pay you or else you write to DOL etc,

tell him that you fully intend to report him to everyone and cause several investigations into his company also tell the IRS of any violations of his and for good meausre threaten to write to your senator to investigate this if any laws were violated
