how long should one wait to fill for OPT if applicable

Hello,
Can anyone please help me out, I filed for a green and an EAD through marriage, INS received my application in August ‘04, and sent us receipts acknowledging they received our application.

However, after two weeks i got a letter asking for additional evidence, and the letter said that processing of my EAD will start only after they receive the additional evidence.

The additional evidence got to them on December 9th '04, so now its past 90 days and i have not heard from INS yet.


My concern is that i will be graduating in may '05, and i don't know if i can apply for OPT and get an EAD while i wait for the EAD I applied for, through marriage, is it possible to do that?

Also, are they any formal procedures i need to take with my school's international programs office to tell them I’m currently adjusting my status?

Finally, i have not done fingerprinting yet, does INS to tell one when to do so , or should I schedule an appointment by myself ? , could this also be a reason for my delay?


I will really appreciate any bit of advice; I’m really frazzled right now.

Yes, you can still apply for OPT EAD.

No, there are no formal procedures. After you are absolutely sure that you are in AOS status (that is, you have the receipt for I-485 and you have submitted RFEs), you can simply email them and tell them you are in AOS status. They will make necessary adjustments in SEVIS.

You will not get your EAD until you do the fingerprinting. On your notices of receipt, it should state that you need to call 1-800 number and make an appointment for fingerprints and biometrics. Do that and get fingerprinted. If your passport is in your maiden name and you submitted your papers in your married name, do bring a copy of a marriage certificate with you to biometrics.
