Please i need help before i apply for citizenship.

Hello everyone please help me out,thanks.

i came to the US in 2005 and got married on 2008 with an American citizen. Before i became a permanent resident, my ex brother-in-law told me to get an i.d so i can apply for jobs so 2 days later a guy showed up at my house and said that my ex brother in law had sent him so he could help me get an i.d... so he takes me to the driver facility( i didnt know why at the time) so he said we are going to get you an i.d(no driver license)... so he translated everything for me because i didnt know english at the time(2008) so i guess he used somebody elses birth certificate and ssn so i could get an id. all he told me to do was sign the papers like the name on the birth certificate. so i got the id and everything but never used it or applied for work....
2010 is when i get my green card and everything was perfect. 3 months after becoming a permanet resident i got a letter in the mail from the deparment that issued the id saying that my driver license was being suspended because of false information.2-3 weeks later i had to speak with a detective because they found 2 pictures with different names( my real name & the id name i got) so i told them the truth what had happened,how i got the id and everything so he said thank you for being honest and left so time passed and i got a letter on the mail saying they were going to suspend my license for 12 months for what "i" did.

so when i got the i.d i was illegal in the US so when i went through the process of my green card the uscis never said anything to me for having 2 pictures(biometrics and "fake" I.d)

now i want to apply for citizenship but im scared because thanks to that guy i claimed to be a citizen(false documents you name it...) before when he took me to get the i.d but he translated for me( i didnt talk at all during obtaining the id)

what do you guys think about my case? should i go an apply since they didnt say anything about it while on the process of my green card?

should i just stay permanent resident? my GC expires in 2020
 
You used a fake ID for the green card biometrics? Why not use your passport? Does your green card have your real name, or that fake name?
 
no that fake id was only to get a state ID and thats it i never applied for work with it or anything else....
the process of my green card was with my real name(mexican passport and tourist visa) and i didnt have any problems becoming a permanent resident.

You probably need to talk to an attorney--however--as you probably know claiming to be a US citizen is a big "no no". However, given that you didn't speak English back when you got that ID, and were guided by someone else getting you documents, you could probably take the position that you didn't willfully claim US citizenship. You probably knew the transaction wasn't 100% legal but you may not have willfully been trying to claim US citizenship back then.

However, there are still things I'm unsure of in your post. For example, you say that when you got your GC, you had a Mexican passport and tourist visa. Does this mean you entered legally originally? How did the state ID or DL people get on to the fact that you had two sets of IDs? How did they connect your legitimate identity (eg the Mexican passport/tourist visa/later GC) with the fake identity you'd established earlier? Did fingerprints or thumbprints from the two IDs (one legit, the other not) match, for example? Did getting the GC somehow tip off the state ID/DL people? Were you ever arrested--even briefly--during your interactions with the detective who was investigating the state ID/DL stuff?

Obviously there is some risk here if you apply for citizenship but more info--and probably proper legal advice--is needed to evaluate how great that risk is. If you can truthfully assert that you never formally claimed US citizenship--and never were arrested--the risk is clearly lower.

The person whose birth certificate and SSN were used may have discovered and reported the identity theft. Once that happens, whoever tries to use those documents to obtain an ID or license would get flagged for investigation.

We haven't been told yet by the OP whether this was a case of identity theft. I gather that is one possible scenario. But I believe another scenario is that the original holder of the ID returned to the country of origin (in this case Mexico) and gave permission for the ID to be used--quite possibly in exchange for an under the table fee--as he/she never expects to return to the US or have to deal with US authorities.

That's part of the reason why I asked whether there had been an arrest. I believe if this was triggered by a criminal complaint by the real owner of the ID, stronger action would be taken--eg an arrest--than if it was just triggered by something not being right in the records.

I suspect the chain of events was:

OP got fake ID with the permission of someone of the same age and gender who has returned to Mexico--providing a thumbprint and/or fingerprint.

OP married US citizen.

OP got GC through the US citizen using their real ID, name, DOB, etc.

OP applied for new ID (or DL) through their state and it was initially granted.

State eventually noticed that the old ID and the new ID have the same fingerprint/thumbprint and a detective was sent to investigate.
 
Everything CALGREENCARD said is true as the chain of events except that i dint get any permission from the owner of the SSN and birth certificate. one of my ex borther in law took me to get the id having no idea what he was going to use as documents. i guess he had those documents and he thought he could use him with me.

they didnt find out through fingerprints since i never had my fingerprints take when i got the id
they did find out through the 2 pictures i had on the system. 1st picture when i got the state id 2nd picture when i got my driver license using my real name when i became permanet resident

i never got arrested never went to court all i did was talk with a detective and told them everything that happened and weeks later they came up with the decision of suspending my license for 12 months
