Hello all,
i am 23 years old guy, from Jordan(Arabian Country), i am going to the states on the begining of Sep. 2005 with a J-1 Visa, which will expire on Nov. 15 2005 ....

i am willing to merry an american citizin girl, who is a relative of mine, while i am there in the states, the question is: after getting married, and applying to a green card, will i be able to change my stay condition, so i can set in the states longer than Nov. 15 2005!

i've been reading about the "FBI Name Check"! and i am getting worry about this, because everytime i apply to a non-emegrant Visa i put On-Hold(adminstrative processing time) for 2 and 3 months, and they always say that i have a Common-Name Problem! ... well, will this affect my case here!

and the third questiong, will i be able to go back to my home country Jordan before getting the Green Card! i mean can i go out the states during the process!

Sorry, but the part of "willing" and "so i can set in the states longer than Nov. 15 2005!" sounds like fraud.

But getting in some of your concerns:
1. FBI name check is part of the AOS process for every immigrant/alien applicant. There are a huge backlog for many applicants and is causing delays from 6 months to X years. Is in vain that you worry about it, is like worry for a flat tire if you even don't have a car and even if you have a car there is nothing you can do about it.

2. If you come to the US with the "intent" to getting married is consider a misenterpretation of the immigration law and can cause you problem. Of course there are others factors that can take in place and overcome that issue. You must proof that your marriage is bona fide and not to avoid immigration laws, in other words you should not commit fraud just because you want to stay in the US.

3. Check the requierements for J-1 visa. There are some issues for AOS that you should check:
"You are a J-1 or J-2 exchange visitor who must comply with the two-year foreign residence requirement, and you have not met or been granted a waiver for this requirement."

4. During the process an applicant who didn't overstay her/his visa can apply for a travel document but USCIS doesn't guarantee the re-entry.

Good luck,

You might have to do a lot of reading on this. There is a 2 year HRR requirement on a J-1 visa and you cant change status unless you have completed your 2 year HRR or applied for waiver. In your case, I guess you need to apply for waiver before you can adjust your status.
