My h1(premium processing) was applied at the end of my CPT. Employer received the receipt for this. INS sent an RFE about 1 month ago which is not yet answered by my employer.

1)I was wondering if another employer can process my h1 parellely. Will I have a problem if another employer process my h1 parellely
2)Since I wanted to change my F1 status to h1, I havent registered for courses this Fall semester(so I am definitely not in full time student status), but if my h1 wont get approved do I have the option of going back to F1.

Any questions answered would be greatly appreciated.

1. If it less than 90 days from opt expiry date, a parallel h1 will not be harmful.
2. If you go back to F1, the period from opt expiry date to F1 start date might be considered out of status, if the H1 does not come through.
The amount of risk which can be taken depends on the type of RFE.
