I have applied for I-485 adjustment of status months ago. Can I go back to CP now. My I-140 dis not mention CP. Please help if it possible.
 
I bet you can. Ask your attorney about how will he file it. The only thing I can think of is that you might get this dealyed by a couple of months becasue you need to take back 485 and ask them to proceed with CP.
 
Go to immihelp.com and read the section on AC140. Assuming you are from India, if your consulate is Mumbai or Delhi, you should be able to get an interview approx 3 months after you mail out your AC140 packet to the consulate. For Chennai, you might be better off sticking to your 485 because you will need to wait for the I824 to be approved.

I am actually from Dhaka, bangladesh. I dont think they will process AC 140.
Also I dont need I-824 approval to process consular processing. The receipt notice will work. I forgot the URL of state department where it mentioned that rule. It is farely new.


I am gathering information.
