Hi, one of my friend is in very confusing situation. She came to usa on F1 visa. then she successfully converted to H1 visa in Oct 2007. after that she successfully transfer her visa to another company and just receive approval notice - date 29th april 08 till date 10th feb 2011. She didn't go for stamping so far.

Now she don't get project from feb onwards and so she is not getting paystub. now she wants to go to India for few months on leave of absence.

Question is
1, Can she go like this way to india if she does not have any paystub?
2, Is she come back on same visa after few months?
3, As she didn't stamp her visa, will she get any problem at consulate?

Please help her. She is getting depress now. Thanks in advance.
 
It appears that your friend need H-1B visa stamping before re-entry. The visa officer may ask for paystubs during the visa interview - thsi may be an issue.

A better strategy is to wait for the time being, obtain a few paystubs and then plan the vacation.

---------------She can go as India has nothing to do with her Pay stubs
2, Is she come back on same visa after few months?
-----------------If She does not have Valid Visa stamp in her passport then she need to get Visa stamp
3, As she didn't stamp her visa, will she get any problem at consulate?
-------------------if she does not have job in US then Consulate will not stamp Visa
Please help her.
She is getting depress now.
-----------She should go back to India and she can find a good job in India, why to get Depressed in US? All the IT people are not working only in US. Thanks in advance.

Thanks for your reply guys. Now the only question is, can she go to India on leave of absence???

and if it is possible, she will ready to come back when she will get project. and as she was leave of absence, according to me, there is no need of paystub at consulate. Is it true?

After Feb she did not get any Paystub it means she was not working "leave of Absence'is when you have work and you need leave.
