Hey Gurus,

A month before I received my GC approval. My GC was applied through company A, I joined company B without invoking AC21. I have left company A 8 months back. Now, I would like to form my own company and start working on 1099. How long should one stick to the employer after receiving GC to be on safer side?

In my case, USCIS doesn't know I am working with Company B. Do you think forming a company and working through it will create any issues for my Citizenship?

Any help will be highly appreciated.

This issue/subject has been discussed in length and so much time that even answering this question (what am I doing?) is not worth. Please search this forum and you will get answer to your question. There is no specific answer to your question.

Forming a company and working through it, is not a problem.
 
I hate the posts that have the title of Help!!!!! or Urgent!!!!! :( This is neither. You have already made your moves, what is the big help you need, or the urgency? I don't see it. Please spend some time searching the forum, there is quite a bit of content on similar issues.
 
As said by others, there is no definitive "magical timeframe" which allows you to change jobs without future hassle. Usually USCIS doesn't care that you changed jobs, UNLESS they something looks suspicious and grabs the IO's attention.

I know that may not help much, but I guess my message is "the gray man has few problems with USCIS".

may be you are master in your own prefession but you have no right to insult anyone ..

Just to let all of you know who passed negative responses Hudak has contributed a lot for this forum with his knowlege in other thread.

By the way to answer your question Hudak , they usually say its better to stay with your GC sponsored company for atleast six months for safe side.

If you leave them early it might complicate things when u go for Citizenship (not sure how USCIS track your employment record). there are mixed answers on this issue talk to your attorney and see what he advises you and then talk one mor desi attorney also.

Certainly I've seen "6 months" floated around quite a bit, but fundamentally this period has no basis in reality. There are no published rules in this area; I've seen people approved even though they spent little or no time at the sponsoring company, and equally I've seen people grilled by the IO despite working there much longer.

Any time USCIS is adjudicating an N-400, your entire immigration history is up for re-examination. With limited time to examine each applicant's file, its usual for the IO to look for common problem areas around residency/travel, taxes, convictions. Employment seems to be a much less interesting area, and typically something needs to be badly broken before it triggers much above a passing glance.

After reading 100s of interview experience, my own impression is they are only looking for clear cut fraud cases. They are most time running short of time and basically running against the clock and have very little time to study each case before the interview and ask pertinent questions. I would not even worry about these issues if you did nothing fraudulent.

AC-21 allows job change before green card and it has always amazed me what is the big deal after getting green card! The 6 month "convention" was before the AC-21 was passed. The convention has stayed on even though now people can change jobs long before they get their green cards due to retrogression in visa numbers.

Bottom line - don't sweat about this. Remember to carry your green card, license and passport to the interview. Read your application before going to the interview. Good luck:)

My bad, I should have search the forum before asking such a question. After Huracan response, I search the forum and found threads
discussing similar issues. I gathered there is no defined rule as to when one can change employer after GC.

Sorry if I was too blunt. It is just that it's my pet peeve when I see thread titles that just show help!!!! or urgent!!!! without giving a clue about what it is. Then it seemed like you have already made your moves, so the question is mostly about how could this affect you in the future. It would seem that your leaving company A could be the potential problem, but if the job in company B was similar and falls under AC21 it should be fine. Once you have your GC you can start your own company if you want. At the end of the day, and as it has been pointed, it all depends on the IO you get for your interview. Some might give you a tough time about your employment history some might not.
