A friend of mine has a problem. I request all the gurus to read it thoroughly and give your input

My Friend got came on H1 for company A in Feb 2001. He then transferred his H1 to company B in May 2001. His passport had the visa stamped for Company A. He then went to India in Dec 2001 but company B forgot to give him H1 papers for restamping and he entered US again with visa of Company A although he was working for company B.

Is it a problem in Green card processing

No not at all. As far as you have the papers with you for both the company you are okay. Nothing to do with POE. On a Green Card application you only mention the POE, POE date and I-94 given to you by the Immigration Officer. Only problem if it happens, happens at the POE itself when IO asks where you work and if you say Comp B and have a Comp A stamp then you have to show Comp B papers also. He may or may not stamp the H1-B there itself.

There should not be any problem in GC processing. My situation was like this.
 
depends on what he did when he was comming back in

if he came back on company A's Visa and told the Office that he works for Company B and showed them company B's H1 papers he shouldn't have any issues because i did the same and my GC is approved.

But if he came back on company A's Visa and showed Company A's h1 Papers i am not sure what would happen because on I-94 we have to specify if we work for a new company if we did not then its assumed that we work for the same company.

I am not sure if USCIS would cross check. If they do then they will find out the difference in the company Names from I-94 info and Biographic info that he puts in for I485

It is perfectly legal and alright to enter on a stamped visa (for any employer) with an H-1 approval notice from any other or same employer as zipper mentioned. I don't think there is anything to worry about.

An I believe at the POE they have the ability to check which is your current H-1 employer and I don't think of a reason that your friend would have told the wrong company he is working for. I meant if he was working for "B", I don't see any reason why he should tell he was working for "A". Also as far as writing in I-94 is concerned that doesn't matter at all as you turn that in when you leave the country, also people loose it all the time. Only thing matters is the current valid H-1 approval.

Thanks for the wishes, actually transfer really helped as I got timely interview and got approved. I sympathize with LiveAndLetLive, Needhelp1 and some other who are same as my date and have no clues.

God bless them and give them green card soon and good luck to others waiting also.
