I have an offer for a job sponsor in the USA. Im from Australia. Im a Personal Trainer and I am offered for a I-129 visa. All I have to do is send the relevant information and paperwork to my employer.
Can someone PLEASE point me in the right direction as to where to start. I need some good information for my employer about it, so if anyone has any links etc...Or if you could explain to me some pro's and con's.

I really am confused, and in desperate need of this to come through.

One more thing. I do not have a college degree. But I have the highest level of Certs in my field. According to what I was told, I can get the visa on a 'Specialty Occupation'.

Is this true?

Which visa would I be applying for?

This has really confused us terribly.

I got offered the sponsorship, but if the quota is filled until next October, then we have a big problem.

I have been travelling back and forth for the last couple of years on the Visa Waiver, and had to leave within the 3 months. And its just got to the point of being to physically and emotionally draining for both of us with the fact that within 3 months I have to leave.

And we want to do everythnig legally and properly.

So we are considering the option of getting married.
 
You are right. The ideas are jumping back and forth, as this whole process is confusing us to no end.
My so went into the cis, and they said in there that I am able to get a H1 for PT. But if the quota is filled then the option is out. We have gone into this with a clear head and discussed all options. But every one seems to hit a brick wall.
Is there any other way to get information? maybe from the embassy? As we do not have the funds for an immigration lawyer. I wish we did. But we dont. And I believe they cost in the thousands.
 
She is a post-grad student. But works alot, and makes enough to live in an apartment by herself, and pay all utilities, car etc.

The fact that I can support myself when I am there doesnt matter?

Do you happen to know what the 'poverty' level is?

Her income being a student is below 15,000. But she lives on her own. So do things like household assets, 2002 model car count towards it?

She also has 31,000 per year fees for school, and income next year of an extra $3,500 as a teachers assistant.

She is coming to Sydney next month, and we are going to see an immigration lawyer.

Please let me know if these can make any difference. And is there absolutely no chance at all should the income not be met?
 
Also, it may be possible to use your income if you are married and living together. Household income can be considered but it needs to be actual income. This is not really complicated, but it is fact specific. As others have said, you need to speak with an immigration attorney.
