Hai,
Anyone who faced with this problem.please answer, i came us on h4 i got h1 in feb 2001,but till now i don\'t have any job.We are planning to go for CP(my husband\'s) so our lawyer told for CP it should not be a problem but i recommend to send application to change status.we Don\'t know what to do.Can any one who have this same and gone with CP please anwer.

Should be "in Status". If you did not have job for a year then your H-1 is out of status. The only question that you need to ask your attorney is that does your visa by default fall back to H4 if your H-1 is not valid
 
I am not sure

whether what I know will help you. A friend of mine was on H4 and then got H1 but did not get a job. Her husband got his CP done in Australia. Sometime before the CP, say about 4 months, they cancelled her H1 and she went back to H4 status. They got their CP done successfully. I hope this helps you.

There is no such thing as automatically going back to H4 status. You have to file for change of status. Best option is to consult an attorney.
