Please help!

I am returning to the US tomorrow, and my H1 has expired, and my renewal for it is still pending. Will I be allowed to enter the US as a visitor while my H1B is still pending (I realize I will have to return to Canada to have the new Visa validated once it is approved). I am really concerned that I will not be allowed in as a visitor.

it is confusing to me what exactly ur status is.

It appears u are a canadian citizen, and ur H1 is expired and you wish to enter on visitor status(B1/B2) but you cannot do that and be able to work as well. if u enter as a visitor you cannot accept employment.

Post more details to get a better response.

my H1B expired on August 3rd. I need to return to the US as my apartment is there...I live there ect. I applied for renewal 5 months ago, and it is still pending. I just want to know if I will be admitted to the US as a visitor until my renewal is approved. I know I can't work until the renewal is approved, and I will need to return to Canada to have it validated. I just want to get into the US. I fly into NY and go through customs there, and I am concerned that they will send me back to Canada. Is this making sense?
 
On what visa are you flying into US? Have you already got your passport stamped with the B1/B2 Visa? If yes, then you may not have any problem.IF no, then I dont see how you can enter US.
