Hi all
One of my friends want to know the answer to this questions adn I don not know anything about the dealing with H1B visa issue.

please help!!!

1. If somebody gets H1 visa and he marries in India, how will he be able to bring his spouse to USA? Can she work in USA
2. Is it possible to change the status to Green Card with those I-130 or I140 or I485? will his spouse be also getting the GC is that is the possible scenario?

H1 Gurus... your reply will be greatly appreciated as one of my friends is in a limbo these days because his girlfriends is playing a big role in his H1B decision and coming to USA and they are both Shah Rukh Khan and Kajol and they cannot live wihtout each other.....

You should give more details before expecting any answer. Also, this is a wrong forum to ask such questions. Anyway here is my take.

1. Where is Shah Rukh Khan now? Had he been to USA before ? Or is he yet to embark on the plane with his fresh H1?

If he came here and went back to marry, he can bring his wife on H4 straight away. It is another matter who will foot the bills for H4 visa fee and the plane ticket. If he got his H1 afresh, even then he can get her H4 there in India with his H1 as proof. You mentioned girlfriend once and spouse once. Girl friends do not get H4 visa AFAIK. Only spouses do. Do not understand what exactly is the problem in getting H4.

If Shah is in USA on H1 already, then sending his details to India Kajol can get H4 straight away. The least problematic visas are F2 and H4. Kajol has to go to Consulate with all details and the visa is given immediately. I have never heard any F2's H4's getting rejected like the F1s and H1s.

Now for GC business. GC process starts with a labor first and it can take 6 months to eternity to get one. Once labor comes thru, an I-140 is filed and simultaneously one can file I-485 (adjustment of status). If 140 is approved, 485 will be processed. Else both will be in dustbin. So the idea is to apply for 140 *ARTER* Kajol comes to USA on H4 - that way both Shah and Kajol get GC at one time.

If an I-140 was already filed, then probably Shah can file another 485 for Kajol. I-140 and Labor do not ask too many details about family (though they do ask marital status etc and INS is very well *aware* that people do get married before a 485 is filed). So if 140 is already approved, Kajol can file for 485 straightaway.

Again these are my 2 cents. Unless more details are available it is impossible to give better advice. And read the signature file below and take your own chances. :) HTH:cool:

If you keep it secret I will tell you (for a laugh!) that this Shahrukh is in love 2nd time because his previous love/girlfriend of 2 years had a love marriage with someone else (a third person):D:D:D:D:D:D:D:D

(I think I should send him the URL to this thread so that he can see by himself both his H1 information and also that he is the talk of the USA:D)

Anyways, he will get the H1 in India and will bring the wife along with him (possibly)

Also, your answers about GC seems sufficient enough for basic information that one needs because filing I140 and/or I485 seems far way in the future. I guess when he comes to USA, he will take care of it and will get to know the whole process in details when he enters the mainstream...:D

Hope the couple can make it easy fast and nice in their life. Here for some unknown reason I remember a nasty thing. Sorry I hope it never happens with Shah. Since Shah has varying degrees of love with various Kajols who seem to have other interests, I wanted to give these details. No intention to hurt, honestly.

When I was a kid my friend (currently in NY) had another friend called V. V had about 10 or 15 bus routes in southern India and was pretty rich. After completing his BE in civil Engg he got married and settled in his hometown. After a dozen years he became so fat that he would not fit in a rickshaw seat. Anycase, then wisdom dawned on him and he wrote TOEFL and GRE. Lo and behold he was in USA with his 12 years old wife and started his life as F1/F2 visa guy in USA.

All went well until one fine day he found his kajol of 12 years - was not found in the apt. He later learned that she moved with another "white guy" and said good bye to our Shah ! Can you beleive it? 12 years of marriage was brushed aside with a single elopment. Our shah or V returned to India broken hearted. I never heard of him again. I met him twice or thrice before all these episodes but not again. I wonder if he had kids before getting F1. I am sure he does. Because in 12 years he might have had at least one or two kids. Or may be not. Who knows how a Kajol can behave? If our Kajol had kids, she might have waited? I am not sure. But it happened for sure. Anything is possible. May be Shah was a freak for her. May be Shah was "incompetent" for her and that's why she did not have kids? May be she had kids and wanted never to go back to the tyranny subjected in 12 years? May be....... questions and questions....

I told this to my roommate and he said - I cannot find fault with Kajol because Kajol was subjected to 12 years of tyranny at Shah's place and Kajol might have expected to travel places when she married a BE graduate.

So that is how things do go - All Kajols have a plan B but unfortunately all Shahs have only one plan. :eek:

He may be broken hearted with what I have typed. I do not have intention to spoil a marriage. Just do not send the thread to him. May be just the advice. Sorry again

I am glad to see that even though lot of us come this far away from our native countries and share our thougts and experiences--happy or painful--in these forums/chatrooms... Humor is still alive:)
