Please help with Canadian married to an American both wanting to move to the US.

Hi All,

I am a US citizen residing in Canada and my wife is Canadian but working in
the US on her L1A visa. We both want to move over to the US and live there
as I also have a job waiting for me there.

With her visa we can currently do that however her employer will not switch
her to US payroll until she gets her green card and quite frankly we cannot
afford to live in the US while she gets paid canadian.

My question is this. Can we still apply for her green card while we both
live in Canada? How long does this process usually take? I\'d imagine since
she already has her L1 and been married to a US citizen for 4 years it
should be smooth sailing.

Any thoughts or advice?

BTW why does everyone in Canada go to Montreal for their green card?

File form I-130; contact the nearest US consulate to find out where to file it. There is a non-refundable fee of US $110.

Thanks for the response. Everyone goes to Montreal to file it. Apparently it shaves half a year off the approval.

So I gather it doesn\'t matter where we live as long as we move over to the US and show prescence to keep her gc valid?

You are right. Your wife is required to reside in the US on a permanent basis only after she becomes a permanent resident. Also, since the two of you have been married for over two years, she should receive a "no-strings-attached" green card.
