Hey everyone, I'm at the point were I have very few options left. My wife and I were married late Feburary of this year in the US. (I am a US citizen and she is canadian) She applied for her gc and went through the biometrics in california but abandonned it when she left to visit some family in Toronto. When she tried to come back, she was stopped at the immigration and was denied entry because she had a one way ticket and no pay stubs.
We have talked to several lawyers and found out about the humanitarian parole which an unsuccessful application was summited to the head officer. Basically, he verbally did not approve the case and said we shouldnt try it at the border. I guess my question now is, where should I file a new gc for my wife? over here or at the consulate in Vancover? I have two lawyers, one can do it here and one can do it over there. Also, in the meantime, my wife and I had set up a hawaii trip at the end of june. Is she still entitled to come as on a visa waiver program as she waits for her green card or does she need to file for a tourist visa? If so, she has pay stubs and credit cards for evidence to come back. Are these sufficient enough?
I'm at a very depressed state and I believe my wife is in worse condition than I am. I hate how we are split like this. Much feedback is appreciated. Thanks
