Please help What to say if they ask ... do you have GC

I am in same boat as everyone with I485 pending for last 2 years. Now I got a good oppurtunity to jump to a new job .....but the problem is - how to convince the new company about AC21 . I am sure they are not aware of the AC21 ....I am not sure if I bring about AC21 , they would hesitate. or would just EAD is good enough for them to make a offer.

This is a very important question and onethat will be very useful for all ac21 filers in the era of retrogression. Gurus please provide some tips

Question they ask is "Do you have work authorization?" You have one. Say you have EAD. It should not be a problem.

you need one letter from company to inform about AC21 to USCIS, that is most imp. thing. In GC company shd be co-operative bcos at any stage USCIS may ask verification etc.

In general, I would say AC21 is a Memo not a law, thats making thing much more difficult for us and that MEMO also not clear with many grey areas.

I saw nobody such as AILA, big lawyers such as Murthy, Rajiv Khanna not taking issue of AC21 to USCIS that it should be very flexible due to lot processing delays in I-485 processing due to retrogression as well as USCIS delay in processing I-485.

In short, nobody is fully supporting employees, supporting employers only, this law came in effect last 5 yrs back, by this time, they should address lot of grey areas as well as give much more flexibility to I-485 applicant. for many things AILA helds meeting with USCIS but for AC21 more flexibility they never held also not a big lawyers such as Shusterman, Rajiv OR murthy thats a very bad thing and its total harrasment to employees only.

but I would suggest if you are getting good offer, dont worry go ahead and get a letter from company about AC21 and send to USCIS otherwise in the era of Retrogression and big sea of NAME CHECK pending its not worth to stay for long time to get GC.

AC21 is most certainly law passed by Congress. The memorandums merely instruct USCIS examiners on how to interpret the law. The absence of specific regulations is a good thing for immigrants - the interpretations have been quite generous and broad.

Be careful what you ask for - you may get it!

Expriry date in EAD is one more concern if we show EAD to get offer ... they say EAD expires in few months why ? .....any suggestion on how to answer ?

I've been asked this question while swithing jobs under AC21. The answer I gave was: "It's like a driver license - when the experiation date nears, I just renew it by mail." Works like a charm. :D
May I give my 2 cents? When you are swithcing jobs using AC21, a potential employer is on a "need to know" basis, and most times they don't need to know. So spare them from all the gory details of the immigration process, otherwise you may just scare them away.
The only thing you may need from them is an employment verification letter (which is also optional, strictly speaking). But that's just a sheet of paper with a few ink drops from a printer. I am yet to see or hear about a complete a@$hole employer who whould deny to give it.

I totally agree with Karaya. Always only give information that's required. Who knows by the time you need an EVL you may, as well, be on another job. To make sure that you will be able to get an EVL just ask if the company will provide a letter verifying your employment if needed. They will not deny it. For the validity of the EAD, just say that you renew it once a year by mail. If asked how long before you get your GC, just say, you are in the final stages and though you can't say for sure how long it will take you anticipate not more than a year. Tell them what they want to hear without twisting the facts.

Your suggestions are the best weapons one can use to convince the employer.Infact I spent money with my lawyer to get the answers you gave.
