Please help VSC processing time and overstay question

We applied I-539 for our parents on June 20(Receipt date). Their B visa expires on Aug. 20. INS website says to apply before 45 days. I thought we applied 2 months in advance and there should be no problem. Now I just looked at INS website and it says they are processing March 27 applications. My question is:

If we do not receive either deny or approval notice before Aug. 20, can they stay until they receive it? If they stay and the application is denied, are they considered overstay and will cause problems for them later to apply visas? Anyone has any information, or sources from USCIS, please help.

We are also in the process of filing for extension. pls. let us know your experience.

I am also in dilemma whether to apply for my Mother's extension now since it is taking 4 months to process I539 applications or to apply 45 days in advance. Second, it is not clear if the visa is void incase the application is denied because there are conflicting reports from differnet people. What are some of the reasons that are considered justified for an extension of B2 VISA?
 
Yes, I called VSC. But their answering machine takes me no where.

They said unless you have life or death emergency, you can talk to a representative. So, what can we do now?
 
Similar situation

We have Rcv date of July 9 with VSC for tourist visa extension. Although we have received a receipt of the application we are unsure of the actual processing time, (USCIS) shows March as processing date which doesnt make any sense for people who are applying for an extension. Pls keep this thread alive and post and progress. I will post any changes in our application status.

First you need to understand that applying for extension is NOT A CAKE WALK. The only justified reasons for extension of a B-2 visa is family emergency situations (eg hospitalization) that are unforseen, OR medical treatment which require the person to stay for a longer time. There might be other compelling reasons, but these are what most immigration lawyers call "compelling reasons" for extension of stay. And only 5% of the people fall in this category. The rest cook up their own friovolous reasons for extension.

6 months of stay is plenty of time to spend with family and visit places. If extn is denied and if they had stayed past their I-94 date, people might face more scrutiny at the POE during their next visit. As per the 222(g) the visa becomes void if the extension is denied and the person stays past the I-94 date, but it depends on how strictly the officer at the POE applies it.

In the end it is your call.
