Please help....urgent

Any information is appreciated..kind of urgent..
I am in the EB2 category and I applied for my I-485 on May 3rd..california.....thats the date i sent in my papers..I have not recieved any notification from the INS since then ..
My company has just informed me that the company will be laying me off and July 1st will be my last day...
Any advice on where I stand ?...am I still fine since my I-485 has already been filed or am i in serious trouble? ...
Any information would be greatly appreciated

Mara, this is a common situation lots of people on this board are facing, only difference is that among people who are laid off/going to be laid off, some have 485 pending for 0 days and some have them pending for 1 year or more. INS sucks, as they have not yet provided any clarification on their 180 days rule. I suggest, try to hang in there, volunteer for a pay cut if required, increase in responsibilities, work without pay etc...may be long leave instead of layoff. Try whatever you can do to stick on the payroll for a few months....other people have also posted a few things on the board, search this section with word layoff and you will get other ideas.

With a downward economy, many people are facing similar situation.
helper007 made very good suggestions. I also like to point out
that since your case is almost brand new (not even received a
receipt notice yet), you may have to start the process all over
again. The most important thing for you at the moment is to find
a job quickly. You will need one no matter what.

sorry to hear that......Helper and Ciba are right....u should be first trying to hang in company by taking a pay cut and at same time try getting a new job...If you dont mind and if u have experience in SAP , peoplesoft or oracle then email me your resume at debo_nair@bigfoot.com

  I dont mind starting my process again (in the worst scenario)....I was just hoping that if my EAD was approved (or if my application was in the pipeline), I would be leagal to stay in the US with or without a job for one year...but I guess i was wrong on that...someone told me that even if I got laid off , the INS would not have knowledge of it at this stage...they would mail me my EAD to my home and that would enable me to be legal in the US for a year...But i guess that was wrong information

My friend was in a very similar situation. After the lay-off, he found a job and told the new company that he would take up the job as a consultant of the old company. The new company would make the payments to his old company, and the old company will in turn pay him. By this way, he could maintain the status for 180-days after his I-485 was submitted. After that period, he took the new job as a regular employee of the new company.

  My friend also had told me that he got his EAD-card during this period, and he could take up another job, had the above arrangement did not work.

  In any case, my suggestion is to try to be in the pay-roll at least you receive the EAD.
