Hi

I have MS+5. My attroney is filing my perm under EB2 with MS+0.

But the PWD says Level 2 with lower salary than what I get presently.

Is is fine to apply EB2 with level 2 wage?? Is this scenario fine?

Yes, it should be fine as long as the Prevailing Wage Determination was approved by out a State Workforce Agency.

Yes the PWD is approved by SWA, but the description of Level 2 says "experienced" whereas Level 3 says "qualified". But in my case MS(qualified) + 0 yrs exp(no experience).

Guys pl help me with this...as my attroney is on the verge of filing my PERM.

if you are OK with level 3, why not just ask him to file with that?

newbie, what do u mean by "okie with level 3" ...PWD is done by SWA and whatever is stated by SWA considered as near final unless Employer does a salary survey.

The question now is - is there some problem with ''EB2- level 2'' combination? Has anybody faced any problem with this before ??

Don't worry...I filed as EB2 w/ MS + 0 w/ Level2 wage

My case is even approved earlier than others with level1 wage...

Mine is EB2 + MS + 0 year experience + Level 3
(Others are EB2 + Level 4 + experience)

I'm not sure what your concern is?
The attorney lowered my experience requirement twice just because PERM doesn't require MS + experience for my poistion

Hi pa_arora,

My LC was filed in PERM under EB2 at Atlanta NPC with MS + 12 months exp. and it got approved. And also my I-140, EAD got approved.
For my case SWA has given level 2 wage.
I hope in your case also it won't be any problem since it was determined by SWA.
