I came to US on a visitor visa in October sponsored by my cousin. After I came here, I got married to a green card holder in December. My husband has applied for his citizenship, and completed his finger prints in Jan 2010 and is waiting for his interview date. I am supposed to return back in April. we were hoping that his N400 application would be approved by my departure date and I will extend my stay and file for I-130 based on his citizenship. It now looks like that his approval might not come in before my departure date. Would I still be able to extend my stay and file for I-130 as soon as he is approved or do I have to return back and then come after 6 months or so and then apply for my I-130. Would there be any problems in coming back to US on tourist visa now that i am married to a US permanent resident/citizen.

What option from below is more practical and less risky?
1. To extend the trip and file for I-130 on his GC and then change my application based on his citizenship as soon as he is approved?
2. Extend my stay and apply for I-130 after he gets the citizenship
3. Go back to home country and come back after say 6 months and hopefully my husband will have his citizenship by that time and apply for the I-130.

Thanks in advance.

Thanks for the reply. No I don't know him before coming to US.

Do I have enough time to apply for my extension now?
