Please help: Travel between Citizenship interview and Oath taking ceremony

I wanted to solicit your help and advice and would appreciate your responses.

My citizenship interview was completed as of July 2006. At the time of the
interview, I was told that my 'Name check' was pending. I am assuming that
the name check would take sufficiently larger time.

My questions are:-

a) Can I travel outside the country in this stage (i.e. between Citizenship interview and Oath taking ceremony). Are there any legal implications ?

b) Typically, how long does this 'name check pending' situation lasts. ?

I'd appreciate your reply.

YES... Travel...

Yes you can. No one can give you an exact time frame on which name check are completed. However, when you are called for your oath ceremony, you need to inform USCIS officer that you travel outside the country. Also, it is safe to bring your itinerary, especially since they need a copy of each and everything.

However, what happens if you are called for an oath ceremony after you leave Uncle Sam? Do you have someone who can call you and ensure that you make US mid-air to complete this process? In anyway, good luck and happy travels...

You can travel, with the same freedoms & limitations you have prior to submitting N-400. i.e. make sure to preserve your continuous residence, and don't exceed limits for physical presence etc.

Additionally, if you're going to be away for more than a few days at a time, you probably want someone checking on your mail, just in case an oath appointment letter shows up.

There is no way to know how long you'll be stuck in namecheck. You may want to consider filing a 1447(b) lawsuit after you've waited at least 120 days from interview.

Thank you so much for your reply. I would be away for 14 days and chances are
that if the the call for oath ceremony has not come till now, it won't within the next few days too ... what would happen if I miss the oath ceremony ?

Thank you so much for your valuable input. I will be completing the 120 days
this month. What is the process to file a 1447(b) lawsuit ?

There is a huge sticky thread covering that topic at the top of this forum.

BTW, if you miss an oath appointment, USCIS will send you a letter and ask you to write back so they can reschedule. Miss more than a couple and your case gets administratively denied.
