The I-864 is being requested.

My income (the immigrant) will be used to qualify.

My wife (USC) will submit her tax return, w-2, latest pay-stub, and employment letter.

Do I submit?:
1. My last tax return?
2. My last W-2?
3. My latest pay-stubs?
4. Employment letter?

Can the pay-stubs and employment letter be mutually exclusive?

hm..did you not submit I864 already with I485?

This is from the section 24 of the I864 instructions:

If you included the income of the intending immigrant whois your spouse (he or she would be counted on line 21a),evidence that his/her income will continue from the currentsource after obtaining lawful permanent resident status mustbe provided. He/she does not need to complete FormI-864A unless he/she has accompanying children.
----

I would say send everything you have listed. Send paystubs for the past 6 months for yourself to show steady income. Send a very recent employer letter mentioning the hire date,current salary etc. Also send either ta transcripts for the past 3 yrs OR copy of returns for W2 ( for past 3 yrs). Send for 3 yrs..instead of only 1, to be safe. You have already received an RFE...cover all bases. good luck !

I understand that sending everything is the safest, but I am trying to really understand the true requirements.

Can I send pay-stubs for the last 3 months since anything before that in is the W2?

Wouldn't an employment letter and current pay-stub provide the same type of information?

Also, I have not been able to renew my work permit (long story), so part of my earnings would be from non-authorized work.
I was authorized to work for many years before now.
This is why I am trying to send the least possible.
