Please help regarding revalidation of h1b visa

Hello All,

My h1b visa stamped on passport expired on Sep 2001. Since I changed the company and I have I-94 validated till April 2004. I have sent to St. Louis for revalidation they told me to apply in India since they dont have knowledgeable officers to analyse. I dont know why they mentioned that. Since my passport expired, I have renewed it and send the old and new passport for revalidation. since there is no entry in new passport, I assume that state dept does not understand even though the old passport I have a valid visa.

My question is
1.What is the time limit that I can stay in USA after the stamping expires in passport?. I dont have necessity to go to India right now. Is it a must that I should get stamped within one year after expiry date.

2.Is it legal to stay if I-94 is validated till April 2004 and will there be any problem if I go to India for h1b stamping in India?
3.Am I eligible for revalidating my h1b in canada?

Reason for refusing revalidation

What reason did they give you on paper for refusing your revalidation at st.louis ?
 
You are fine... no need to revalidate

There is no such requirement that you should revalidate within a year. In fact, if you not planning a trip abroad, there is no need to revalidate at all.

Since your I-94 is valid till 2004, you are legally allowed to stay till 2004 regardless of the validity of you visa stamp.

Reason that they mentioned was there is no knowledgeable officers here to analyse. It is a standard letter that they sent asking to go the home country and apply for VISA.

Visa Revalidation with old and new passport

State Department web site says that you can send both old and new passport for revalidation.
I also need to apply for revalidation with old and new passports. The old passport has the visa stamp
and the new one is brand new with no entries.
What do you suggest, not even bother to send it or give it a try.

I don\'t understand why they have sent your PP back based on that reason, I was also having new passport and sent to st Louis and got back with stamping.

Random you can send it to StLouis , not every case with this situation is turned back, I am assuming it\'s just badluck or clerical mistake

Thanks for your reply. I will go ahead and send it. It looks wierd to me too for that to be a reason of refusal,
though you don\'t know as they did not elaborate the reason.
