please help on (rfe) i have been found to be inadmissible

hi every, body on june 29/2005 i received a(rfe) and a form of I-602 application by refugee for waiver of grounds of excludability. since a had a reaction on my skin tb test because of( bcg) but my X-RAY was normal and when i received that (rfe) i just told my self this is most to be for my skin test resulte so i had go back to my ins physician and to my local health facility since i had no tb active or inctive my physician send a note to ins to let them know that im not sick and im not a threat to others . so the health department lady gave me a note said it was up to me to take or to refuse preventive tb medicine since i had no tb so i refused that 9 or 6 month treatment and i send all the requeste back to the ins according to my case status my response was receive on july 26/2005 and tow weeks after they receive that they send me an other( rfe) on august 03 /2005 requesting the same stuf so i made copy of every that i already send them before in case they lose the first one. according to my case status my 2nd(rfe) response was received on august 16/2005 and yestday i receive e-mail said that the send me a 3rd one :confused: so ofcourse i was sick all night long and today i cald the ins cost service and the lady was so kind she put me on line with a IO and what the IO told me realy shock me :eek: she told me to see on the last page of my (rfe) the page say :ATTACHMENT YOU HAVE BEEN FOUND TO BE INADMISSIBLE, OR INELIGIBLE FOR ADJUSTMENT OF STATUS,UNDER SECTION 212(A)(6)(C)(I). MISREPRESENTATION "ANY ALIEN WHO,BY FRAUD OR WILLFULLY MISREPRESENTING A MATERIAL FACT,SEEKS TO PROCURE (OR HAS SOUGHT TO PROCURE OR HAS PROCURED) A VISA,OTHER DOCUMENTATION ,OR ADMISSION INTO THE UNITED STATES OR OTHER BENEFIT PROVIDED UNDER THIS ACT IS INADMISSIBLE". THEFORE,YOU MUST COMPLETE THE ATTACHED FORM I-602, APPLICATION BY REFUGEE FOR WAIVER OF GROUNDS OF EXCLUDABILITY. i ve told the IO this since never been in trouble with the u.s.a law or local state law i did'nt pays attention on that pargrafe on the last page and the IO told me that the( rfe)s that i receive was not for the skin test resulte all my (rfe)s was for the misrepresentation stuf on the last pege of the I-602 . now guys i do not remeber to used any fraud document in my asylee application in1998 or in my I-485 in august/ 2000 the only thing i know and the INS know pasport that i used to came to u.s.a was not my pasport and i ve told them in my asylee interview in arlington VA and the have that pasport the orinal every cinse my interview 1999 and i ve told them the reason why i had to used that fraud pasport and you guys know more than 80% of asylees always saved they lives with others peoples pasports to ge out of they countrys of persecution in other to protect them self . ok guys please send a replies as soon as possible thinks my time line is :ASYLEE GRANTED ON 03/ 5 /1999 - ND 08/ 23/2000 - 1st FINGERPRINT ON 05/ 20 /2004 - (RFI) MECAL ,BIOGRAPHI, SUPPLEMENT FORM ON 03/ 7 /2005 and was received on 03/ 23 / 2005 - 06/29/2005 i receive my first (rfe) respond on 07/26/2005 biometric code(2) done on 07/26/2005 . 2nd(rfe)receive on 08/3/2005 and repond on 08/16/2005 3rd(rfe) on the way was send on 08/18/2005 . please help me to comlpete this I-602 REGARDING MY FRAUD PASPORT wich i had not probleme in my interview in 1999 in irlington VA asylee office . my lud change from 08/4/2005- 08/16/2005- 08/17/2005 -08/18/2005- 08/19/2005

Hire a lawyer

Hire a lawyer, find out what part of your file raised the flag. And then let the lawyer deal with it.

You need a layyer right away.

You may need to receive 6 to 9 months treatment that you refused before.

Don't worry ... have you lawyer fill out the I-602 waiver form with as much supportin docs as possible and it's almost 100% they will grant you the waiver ...I went thru the same thing for my "fake" passport (if you do a search in here you can find the postings) and had no problems....
 
Relax. They have very very generous standards for waiving the use of a false passport in asylum cases. Bascially every body is approved as long as she establishes the fraud was needed to escape from persecution.

Have a lawyer write up the petition.

This is not a big deal for you.

But note that if you were applying for a basis other than asylum/refugee, you would have a HUGE problem and would almost certainly be denied. (a good point for people who want to "go home" to keep in mind).

Sorry I couldn't get to you sooner... I can tell by your posting that you are VERY worried - and that's understandable.

The I-602 waiver is a general form designed specifically for refugees and asylees to get a waiver in order to allow them to adjust their status to that of permanent residents. So, its actually a good thing this is happening. CIS cannot give you PR status if you illegal entered the country, which you have confirmed by indicated that you used someone else's passport to enter the USA. This is a form of fraud by the way. By giving you the chance to show why you did this, CIS is going to waive the ineligibility clause and adjust your status. Its actually a great process because only asylees and refugees can get a waiver - aside from cases that have a strong humanitarian need.

So, back to the main question: how do you resolve this? Simple. Fill our the form I-602 completely and provide an explanation as to why you used a fraudulent passport. First make sure you include details from your asylum case about why you fled your country, and the persecution you feared. Then find new data and information (preferably from a known source like the State Department or the UN) on the state of your country. If its still unsafe for you, provide that information as evidence of what would happen to you if you were to return. If you have family here in the USA, such as US citizen or PR spouse, parents, siblings, cousins, uncles/aunts, etc - make sure you also add in a hardship angle. Meaning how tough it would be on them and you if you were separated.

If this seems too much for you to do on your own, I would take our fellow posters' suggestions and hire a lawyer. I want you to know that I personally when through this I-602 a few years ago and I completed the form and provided evidence by myself. It took approximately 2.5 weeks after sending in my forms to get approved.

Relax. It really is a good thing you are being giving this chance to waive the ineligibility clause in the INA Act. If you weren't an asylee, you would have been denied at this point.
