NIW2005-2006

Registered Users (C)
I got RFE today which is issued on Feb 23rd, although my LUD never changed since I submitted the application.
Any comments are highly appreciated. Is it a tough RFE? What kinda materials that I should prepare? especially for the first three paragraphs.

Thanks a lot.

You must proved evidence which addresses your eligibility under each of the following:

NSC/dne EX461

Eligibility for the requested waiver entails demonstrating that the national interest would be adversely affected if a labor certification were required. You must demonstrate that it would be contrary to the national interest to potentially deprive the prospective employer of your services by making available to US workers the position you seek. If self-employed, you must also establish the national interest would be adversely affected if a labor certificate were required.

If you demonstrate that you hold a patent or are responsible for an innovation, then you must demonstrate that the specific innovation serves the national interest.

You must establish you have a past record of specific prior achievement which justifies projections of future benefit to the national interest. You must establish, in some capacity, your ability to serve the national interest to a substantially greater extent than the majority of your colleagues. You must demonstrate to some degree your influence on your field of employment as a whole.

Please submit copies of grant applications/award documents for all research in which you are currently participating or participated in previously. The complete documents are not requested but please submit all cover pages and pages identifying the research participants and roles.

Please submit copies pf any published articles by other researchers citing or otherwise recognizing your research and/or contributions.

both sumeet & NIW2005-2006.........Sorry to hear about RFE Most of them are interrelated

The best thing to save this is 1. Get as many letters ....(.this will be different than you submitted earlier ) stating that your work is important for XX number of people and you are only you have expertise to achaive that.Loss of .... expertise, knowledge and skills would seriously affect research program and jeopardize the plans concerning research....Labor certification is recently addressed as quick process (especially with arrival of Perm system) ...carefully argue time issue with respect to labor...good chance of losing multiple million grants required for success of project can be another apscet of discussion................explain that your Request for a National Interest Waiver is not based on labor shortage of qualified workers in the given field. explain that your boss did Conducted a national search in international journals and news letters for suitable candidates with experience and outstanding accomplishments in my research field.......................

If you demonstrate that you hold a patent or are responsible for an innovation, then you must demonstrate that the specific innovation serves the national interest.

letters, articles demonstrating the use or possible use of patent will help here...get letters from industrial guys.....clear the values in numbers or money wise in the letters.....show some data if you have analyesed demosntrating the use....USCIS guys like number game...like XXX millions suffering XXX millins money spend.....etc etc

list all your acheivements ...expertise required for that ................future plans ...national interst and your expetise to acheive that...confirm all this thru letters also...................explain that this kind of research requires a scholar to have both a broad, interdisciplinary background and experience in XXX fields............

Please submit copies pf any published articles by other researchers citing or otherwise recognizing your research and/or contributions.
