Hi folks,
Please help me answer this question, specially Johny Cash, that i think he was the senior at his forum.
Im applying for citizenship at 07/18/05, FP 11/02/05, and will get interview at 02/02/06, i'm doing all of this without lawyer help ( honestly, i cant afford them ), but lately i hear a lot of thing from my friends and now that become my nightmare, please help me to figure his out!!
1. I have been arrested before, for grand theft auto at 1986, hit and run
at 1989, and i didnt write it on my application, i thought we only need
to write last 5 years record. My friends said i should mark YES at question
number 16 untill 21 ( HAVE EVER BEEN ARRESTED, CITED, DETAINED,
HAVE YOU EVER BEEN COMMITING CRIME, HAVE YOU RECEIVE SUSPENDED
SETENCE, EVER BEEN IN JAIL/PRISON )

The way the question is formulated it basically refers to your whole life, even before you came to US. In my understanding the word EVER implies that.

I didnt know i should write yes, did the officer will asking me at interview
later? If yes, what should i do? Is this will be a problem later?
2. I was marry with my wife at Sept 2004, she has visitor pasport at that
time, and expired at Nov 2004, i dont want she go back to her country
and wait for me, i told her to wait my citizenship.
I was looking for information before, and it doesnt matter about her status
if i become citizen, but now i hear that the officer will asking about
my wife status at interview. What should i answer?
Should i tell him honestly my wife doesnt have permit to stay?
Is this will affect to her later? I'm worried if the INS come and evicted her.
I don't want her got trouble because of me, i want being together with
her over here. For your infrmation, i got my GC at 1982.
So far, i cant find any thread about my case here, please help me to figure this out. This interview appt makes me crazy every day, but i need the citizenship for my wife.
Thank you in advance for your help guys!

I don't know what others are going to tell you, but my advice, you can afford it or not, YOU HAVE TO GET A LAWYER, AND A GOOD ONE?

thank you

Thank you very much for your opinion!
I have other question, if i'm hiring a lawyer, will he come and sit with me in the interview? Did anybody know there's any good lawyer round here? I live at LA county, i hear you need to spend more than $1000 for lawyer

you will have to ask the lawyer if you would come and sit with you in the interface. I am sure if you can pay him good money, he would be willing to do that. after all, they charge you by hour and i do not think they have anything to lose.

I had to take my lawyer with me to the interview, and he charged me $1250 just for showing up plus any incurring charges while he is in the city where the district office is. In my case we both live in nashville tennessee and the DO is in Memphis, 3 hours away from nashville. I was charged $750.00 for preparing the paper work and the affidavits needed for the appeal.

If you are interested in knowing more, you can read my thread, " i got denied please help" or decision is overturned -sony".

Good luck

Sony

Any time you are talking about expired status or potentially deportable offenses you HAVE to get a laywer. The $1000 you save may be spent on flying back to your home country.

If it was me I'd get a lawyer.
