Please help need advice urgent

Hi,
I need an advice, please help.
I just got married a month ago with an american citizen originaly form another country.I'm actually on F1 visa, which I20 is ending in febrary.My husband was married 6 years ago with a woman living in south america, but her visa got refused after the interview at the embassy, because the officer classified it 'fraud marriage". My husband wasn't charged of anything because there was no proof that the marriage was a fraud.He engaged a lawyer to prove it,but after 3 years of marriage, he had problems with his exwife and they divorced.
Now he wants to apply for me, my question is: is he going to take a risk by applying for me? should I keep going to school to maintain my status? Please give me some advices, I'm really lost now, I don't know what to do.

You and your husband should consult with an attorney; if the previous attorney an immigration specialist (rather than divorce), he would be a good person to deal with as he knows the past situation well.
