Hello Everybody, I am bit confused hearing all different versions of advises. Well it shd be land of confusions :p

To start with my confusion, I am currently on H4 visa.

My Wife on H1.
Sister as US citizen
Mom as Green card holder. She will complete her 5 years of stay on GC in March 2002 and will be applying for her citizenship.
Considering this, few friends of mine say I can get Green card as soon as she gets citizenship (or when she takes oath n files for my status change).

Some say - No I cant get GC even though she files for me at the time of her citizenship oath. And I have to wait for next 4-5 years to get GC.

All this is so confusing for me. I dont know the correct procedure n whom to contact for correct info. How many years of wait shd I anticipate when my Mom files for her citizenship in March 2002. How shd all this visa change should be done?

Please help me out with some advise. Thanks in advance.

I understand we fall in third category. And i also understand it will take 4-5 years of processing period. But once my Mom files for my change of status from H4 to Family based GC status (i dont know the name of it), will i get the SSN or work authorisation thingy? Or even that comes only after 4-5 years of waitg period.

You get a work authorization only after you (not your mom) file I-485 (As Joe says, this is the last step in GC processing) and you cannot file that until your priority date is current. Currently people whose priority dates are before May 96 are allowed to file their 485s. Your priority date is the date your Mom files the I-130 application for you based on 3rd preference category (provided that it gets approved). And she can file that application (I-130) only after she becomes a citizen i.e., takes the oath.
