Could anybody tell me whether a person who is in out of status could get marry to a green card holder and get legal status? Could that green card holder apply for the spouse category visa for the illegal alien person after they legally got married?

Help me please.

if someone marries a permanent resident, the permanent resident files I-130 at appropriate service center. After approval, the National Visa Center will hold the petition until the visa becomes availabe. If the spouse is in the US, he/she should file I-485 after visa becomes available. (watch the visa bulletin: ) the spouse should maintain legal status as, the waivers are different for persons married to permanent residents than for persons married to US citizens. consult an attorney if your spouse is illegal or out of status alien.

Once He/she Gets Married They Will Have To Wait As Per John's , It Will Take Good Somewhere Up To 6 Years To Get A Visa , He/she Will Need To Maintain In Status Until Visas Comes Availible .
In A Us Citizen Case Marrige He Will Be In Ad Of Status Within 3 Mths Then Interview In 8-10 Mths .
