it has been 4.5 years since I got my GC and I heard we could apply to citizenship.
1) is this true
2) could someone give me a brief explanation what are the step to apply for it
3) is it worth it to use a lawyer?

Hi Alfredo,

1) You can apply 3 months prior to your 5 year anniversary. So you can apply 4 years and 9 months for citizenship, you still have 4 more months to go. Don't apply too early or they will deny your app. and keep your money.

2) You should go to www.uscis.gov and follow the directions to apply for citizenship.
Basically, you fill out and send app. N-400 with $675 and 2 passport photos and copy of green card, both sides. They will send you Nptice of Action for receipt, then another one for fingerprinting appt. After appt. You need to wait for NoA for interview. If you pass that, then you will get oath letter. After you appear for the oath ceremony you will become US citizen. The whole process could take 6 month to a year or more.


3) if you have any convictions or inconsistencies in your past, then it is advisable to get a lawyer. If you have a clean record , then you can do it yourself....
 
So is that rule of 4 years and 9 months a fixed rule or I had to add the days of vacation that I had taken
 
The rule states you can apply up to 90 days before you have reached 5 years of continuous residency as a LPR. A few vacation days here and there won't break continuous residency.
 
yes, the only time that we have been outside of US is just vacation, I think only one time we stayed for 5 weeks in southamerica for vacation, other vacations has been for 2 weeks each time, can we still apply at 4Y and 9 m?

Yes, as those vacations did not break your continuous residency. Unless you had trips more than 6 months or back to back trips just under 6 months, you wouldn't have broken continuous residency.
 
is it true that before I sent the form 400, you shoud have been in the US for the previous 3 months, not even for vacation? or that is not correct.

You have to be a resident in the DO service area for at least 3 months before you can apply.
