Hello all,

My Current H1 expires this December and my H1 6 years will end by 2003 May. During my stay in US, I was on vacation (in India) for 3-months. Now, while I'm applying for my last H1, can I add these three-months to my H1-6-years limit (that makes it up to 2003 Aug)? Is that possible? If so, how can I do that? Are there special forms I need to fill in while filing for my H1? How do those lawyers do this? Do I need to send some additional paper work to the lawer? Please advise....

No, there is no way to capture "vacation" periods.
You can only get back long absences on overseas work-related deputations (assignments that are "different" from your usual duties), maternity leave etc...

As always, check with your lawyer. I got back a fair amount of time but none of the vacation periods. In fact, my lawyer strongly advised me against trying to recapture that time as that would have weakened my case!
