Please help me - Lost Passport - Is it possible to get H1B extension?

Hi All,

This is one of the strange incident. I request you all to provide your valueble advice.

My passport expires in December 2006 and H1B expires in June 2007. But unfortunately, I have lost passport, in which I have my H1B visa stamp. But luckily, I have the xerox copy of all the pages of my lost passport. I also have the xerox copies of H1B visa and I-94.

In place of the lost passport, Iam sure I will get a new passport from Indian Consulate.

Now my concern is, once I get my new passport, if I apply for the H1B Extension in Janury 2007 by submitting the xerox copies of my old and new passports including xerox copies of H1B visa and I-94, can I get the extended I-94 from INS?

Or Is it possible that INS might deny the extended I-94 and ask me to go out of the country and get my H1B visa stamped in India?

Please help me ...

---- Normally, when you extend your H!B, you will get your I-94 attached along with the I-797. there is no need to worry on this count. However, if you want to travel out of US during this time period you may have to the nearest POE and apply for a new I-94 submmitting all the relevant documents. Please check with USCIS and CBP websites

Or Is it possible that INS might deny the extended I-94 and ask me to go out of the country and get my H1B visa stamped in India?

---- When you get your new I-797 (H1B approval notice) and it does not have the I-94 attached to it at the bottom portion. The USCIS will advise you accordingly. Till then you can relax

----------- For H1 extension only copies of recent valid H1 approval and copy of I-94 is needed +documents from employer I don’t see problem in extension and you can also submit affidavit and police report copy talk to your lawyer

Or Is it possible that INS might deny the extended I-94 and ask me to go out of the country and get my H1B visa stamped in India?

You need to file a police complaint for lost passport with valid visa stamp. Get the copy of police report and get new passport.

If possible inform the consulate from where you got latest H1B stamp that you have lost the passport vith valid visa stamp. Send the copy of passport pages with visa stamp pages, police report copy so that they keep watch so that no body misuses it. Keep the record of letter sent

If you search the threads you will know that person went to Canada to get his H1 visa stamping and got the H1 visa stamp and lost his passport with valid visa in Canada and filed a police complaint and informed the US consulate in Canada and reached the US border post and the officer checked the computer system and was allowed in to US. Get more info from your lawyer

i am a bit confused......do you mean when we get a visa extension or a different status visa(J1 to H1).........we get a new I-94??........i thought I-94 is only issued at a port of entry??

---- If you are already on H1 and extending, renewing and even transferring then normally you will receive the I-94 attached to the bottom of I-797

---- If you are applying for fresh H1 with even a Change of status (COS) at times you will receive the I-797 (H1 approval notice) without I-94. During these occasions you may have to leave the country, get your visa stamped in a third country and then return to US and at the POE you will be issued a I-94 for the validity period of your H1

---- Most of the occasions I-94 is issued at the POE.

i did not know about the I-94 attached with i-797, it does exist....thanks.

i am supposed to staple and hand over all the I-94 to flight attendant while boarding the flight, right?

---- Not to the flight attendant. The I-94 is handed to the person at the check in counter and they will staple it to one portion of your boarding pass. This boarding pass will be collected from you while boarding the flight and you keep the other portion for your records, retrieval of luggage and seat identification
