Please help me(important filing question)

Hello everyone, I'm a new person in here, i think i asked one question last month, got my answers back, thanks administrator and those people who are helping. God bless you!
I have some questions. If you could answer it, that'd be awesome.
I got married in june, and I'm a student now, just paid off my college. I'm using my unauzorithed SSC, i got it thru college. and I have no money left for filing the petition. My wife is working and spending money for living expenses. So, I'm workin, gettin paid not much, but, my question is: Is it ok if my wife file the petition sometimes next year? or, i have another option, i can cancel my study and get my refund and work on gc w/ that money, but i'd lose my status. what should I do? should i just wait till next year, till i have money to do everything, or should i jus drop my status and get my refund and work, and file the petition?
and also, another thing is, me and my wife didnt have a big ceremony, me and her just went through disctrict justice. is it ok that we didn have a real actualy big wedding? by the way, my wife is usc

if she can qualify the requirement to sponsor you, i don't see problems., She needs to have her income higher than povery level since I believe your income won't be qualified due to unauthorized work, if I remember correctly.

That is right. As I pointed the other day "income proceeding from unauthorized employment" can not be used to meet the poverty guidelines.
 
I'm not sure I'm reading this correctly... is the problem that you and/or your wife don't make enough money for the affidavit of support, or is it that you don't have enough money to actually file for your green card and pay all the associated fees?

I was at school with a guy who couldn't afford to pay the filing fees and the medical exam costs and it stopped him filing for almost a year. He ended up getting help from a charity. (He's a highly educated guy from the UK, but he couldn't work legally as an f-1 student and his wife was young and still in college, so they weren't able to save.)

thanks a lot guys, I guess you didn't understand my question. I'm not worrying about affidavit support forms, my wife's parents are rich, they might help with those documents, but they can't help w/ money. I mean, I need money for filing it, like fifteen hundred dollars, to file those two forms, and neesd some money for bio.., and also, might need need lawyer, that's why, please, advise me what should i do? should cancel my study to get my refund and use it for filing forms? or should I wait till next year, till I get enough money. the reason that, I'm saying till next year is because If i don't cancel my study, I'll have to make money for my next semester, and from january 2009 I can save up some money for filing petiton.
Please, I really need your help. I don't think you ever heard this kinds of problem, but I do need your help

I was an F-1 student and then filed for AOS, so I can share my experience and hope it helps you.

Once you file to get your green card through marriage, you essentially end your student status (this is NOT always true on some working visas, like H-1B, if I'm correct.) You can stop going to school while you wait to get your GC without worrying about being out of status. You should also be eligible for work authorization (called an EAD.) You normally get this within 90 days of filing. Then you can work legally, get a SSN, open bank accounts, etc. You don't have an official status while you wait for your GC, but you are 100% legal and you will not be building up overstay days.

The risk: if you are denied for your GC (for example, if you can't prove your marriage is real or you can't meet the income requirements) you can't fall back on your student status. It's gone once you file for your GC.

The benefits: you get to work legally, you can file for advanced parole to travel (if you've married a USC, I would not leave the country and try to re-enter on your student paperwork) and hopefully, you will get your GC within 6 months-1 year.

In your situation, I would consider filing for the GC now. It depends on how important it is to you to finish your studies now instead of sometime in the future... whenever you file for your GC, you will face the same risks/benefits.
