Hi,

This is regarding H1B and I know this is not the place to post still I feel experts advice from here will help me a lot.

I have H1B valid till NOv 2005(with prev employee) and applied for transfer on April 12 and changed the job and did see that H1B transfer also got approved online, but never recieved I 797 from INS(nether me nor my employer). My attorney called UCIS to let them know still they did n;t send the I -797, but sent a letter saying that, I -797 has already been sent to you.

NOw I don;t have any proof of my status though H1-b approved.

Please suggest me what should i do now.

Looking for I 824( for duplicate copy), processsing dates for 824 is around 2and 1/2 years.

I dont think that you need to worry for a mistake what INS has done. You have proof of filing your H1B transfer(receipt notice), you also have the approved copy taken from the internet, having the receipt number.

You can probably take both of them, get it notarized and send it back to INS explaining your situation and also send it through certified mail, so that you have a copy of the mail being received at their end.

Also, ask your employer/lawyer to give them a call and tell them that you havent received it and tell INS that you are ready to bear the expenses by FedEX and give your credit card number for them to charge it and ask them to send a duplicate copy of your approved notice.

I have done it for a different scenario but not like the one that you have stated above.

INS sometimes do listen to your queries(if at all you get to the right person at the right time)..

H4 for my family was lost in mail. We sent a request for duplicate copy and got it in about 2 weeks time.

How did you sent a request for duplicate copy?
Is it by letter to INS or through I 824?

not sure how close is your case to mine. But for my spouse H4 approval went back to CIS (some mailing issues) and we called them 2-3 times and they sent us a notice saying we need to file I-824. After we did that Reciept notice for the same with wrong name came(problem after problem). Then we talked to them again and talked to someone who directed us that file the same application again with the copy of the check that it was paid,(but in our case CIS had the record that they recieved the notice back for non-delivery) with original application and mark the application as Expedite. We did that and recieved a Duplicate copy in about 2 weeks time. Its probably good if you talk to your lawyer and see that if this is a possibility.
It's not a legal advice just the way we did.

I dont think UCIS have sent any I -797 to me since my company also did not recieve their copy. My attorney says that there is some problem in their system(Software). Status gets updated but docs never get sent. He says its not the first case in his exp and he is exp many cases like this in recent days.
