Please Help me calculating....

My employer is Chicago based.
I am eligible for RIR type of GC processing.

If at the current rate of processing times prevail and if i start my GC process by filing labor today (Mar-04-2003)....when can i expect my EAD?

I was trying to track the various sites for timings but iam very confused in calculating all the stages in GC.

Some of my friends say we can get EAD within 1 year...is it true???....but where as when i see all the processing times i get a different picture.

I would appreciate if someone could help me in this regard.

So what are you options?

Instead of doing the calculation of the timing. If I were you, I would just apply... hope and pray for the best and relax. Thats all you can do.

I personally know people who got GC in 13 months flat. Including Labor,I-140, EAD, AP, FP, 485 - all nine yards for a VSC - EB3 category. I also personally know people whose same nine yards has taken about 60 months... I personally fall close towards the later end of the spectrum. My labor was filled in Nov 99 and I am not expecting my GC approval anytime sooner than Dec 2003. (if everything goes well - which does not seem to be happening) Again VSC - EB3 category case.

Where does that leave you and your quest?

With the current downhill economy, Labor Cert is a very difficult process now. DOL is scrutinizing cases very carefully and basing it on various factors like local market conditions, layoff history @ sponsoring company, local unemployment stats etc. However it is easier to get Labor Cert in under-represented areas. But the situation in metro areas is a disaster. I know of people who filed around 9/11 (2001!) and still waiting labor approval. If you check the DOL processing dates, you’ll see that certain dates have not changed for the past 12-18 months!

Even tho’ your company is Chicago-based, you may be able to file labor elsewhere if you or the client is located in an area where labor is faster. Check with the company lawyer.

Once labor is certified, things should go smoothly. One can file both I-140 & I-485 together and expect EAD within 3 months of filing. But Labor Cert, who knows?
