Please help!!! Lost GC

I will try to make my story as short as possible, but it will be kind of hard!

According to the Immigration lady that I spoke to over the phone, they told me this:

On December 2006 my dad applied for him and my mom my sis and I for our GC's. After all the biometrics and etc, we were all approved on June 11 2007. On June 15th all the physical cards were mailed (to the address my parents live at, although I had already changed my address with them MONTHS before I was even approved for mine) On June 25th mine was returned to them (I wonder why.. hummm) and again on June 26th they resent mine to my parents address. not that I cared about that, but due to my address being changed in the Post Office, them sending it to the wrong address caused them to loose it.

After fighting and fighting with them and filing 2 i-90's as a card that was never received they told me that it was pretty much my screw up cause they sent it to the card on file (Which makes no sense that it is my fault that it was mailed to that address when they mailed my employment card to my "correct" address by 2 years after it was approved, meaning I got my employment card June of 2008, already expired by 2 years since I already had my residency)

Ok, so moving on to current troubles. It took me a while to file the new i-90 because of me trying to fight the fact that it wasn't my fault. And after my fighting went no where, trying to come up with the $370. I came across the "Fee Waiver Request" info. I immediately (November 10th, 2008) filed the i-90 as lost/stolen with the Fee Waiver Request as my "payment" with all of the required forms showing why I couldn't pay for it (I'm a full time mom who rarely has any spare money for anything aside bills and needed foods) I mailed it to that Los Angeles Box that those i-90's have to be sent to now.

This is where I need help...

Anytime I call USCIS they are absolutely no help (as we all probably know). I tried to call just to see if they got my packet (you can't send it certified as it's a PO Box), and they tell me they can't tell me that, or that I can't even call for 6 months from the time I filed.

I have made an info-pass and the lady there told me that yes, they could tell me if they got it, I don't have to wait 6 months for that. She said at that time she couldn't see herself that they had rcvd the packed (I went Dec 12th, 31 days after i sent the packet). She says as soon as the system shows that the packet is received, she can give me the temporary stamp.

Here is where it gets worse...

I can only check if they have the packet if I get an Info-Pass. Lucky I live in the same city that has a location, but they are open the same times I work and I can't afford to take off all the time just to "check". And I can't call to "check" because they wont talk to me over the phone.

I would wait and see where it leads me (although I am tired of waiting when it's not even my fault!) except for now I have these issues to worry about...

My license expires next Saturday, I need my green card to renew.

I am 15 weeks pregnant and can not get Medicaid (insurance) unless I have proof of my Immigration Status (I already pass in all the other requirements)

If I wait 6 months, my license would be expired, and they could tell me no, sorry it was lost, file yet again, and wait yet another 6 months. At 3.5 months pregnant, I don't have that long to wait!

Yesterday I mailed a letter to my Congressman asking him for help. I'm not sure what else I can do!

Can anyone else think of anything? Please help...

The I-551 stamp in the passport is proof of legal immigration status.

But I think your problem is that the fee waiver is delaying your processing, otherwise you'd already have the I-90 receipt by now and could get your passport stamp. They have to follow another process to decide if you qualify for the waiver or not.

Did you file AR-11 for your address change, and also file a change of address for your green card?

They don't keep a single address for each person. They have one address for your main file, and then an address for each of the applications you have with them. So they'll sometimes send your employment card to one address, and then your green card to another, unless all addresses are the same.
 
In regards to the first reply:

I know the stamp is proof for both my license and medicaid, but until the i-90 shows up I can't get the stamp. And about the waiver, I was afraid that would hold things up. But unfortunetly I had no choice since I don't have the money to pay for it :-(


In regards to the second reply:

All original applications were filed with the same address. None (but the current i-90) were filed with my new address as I was still living with my parents when they were filed. My adress was changed over the phone, online and by mail before my employment card was 'lost' and after, and again after that during the green card approval process (about 2 months before it was sent) to make sure. I even confirmed they were changed, yet my GC was still sent to the wrong one.


I appreciate the replies so far but unfortunetly what's been asked/told I already knew (or figured) and I'm still stuck. But your time and response is greatly appreciated.

I have a question for everyone.

My parents found my i-485 'Notice of Action' that we got in 2007 saying that our application to adjust status to permanent resident has been approved.

Could I use that as my proof of residency and renew my license? Would the fact that I got it back in 2007 make a difference or is this good enough proof for the time being? I didn't need it when I renewed it a year ago I just showed them my 'we received your application' i-485 and they gave me a temp one. They send all the info I show them to Tallahasee to get verified anyways so I should be able to use it right?

I sure hope so.

That might work, but you may have to be persistent with the clerks you face at the DMV, as some might insist on seeing the actual card. Explain that although you never got the physical card, you have this official document which showed it was approved, and they should take a copy of it and send it to the authorities to let them verify it, rather than making their own determination on the spot. Ask for the supervisor if necessary.
 
Sorry to bother again, but I have another question...

My parent's just handed me the NOA that showed the approval, and I am reading over it, getting VERY mad...

This letter was received by my layer BEFORE the Biometrics appointment NOA was sent.

The "Approval" Letter (rcvd May 2007, which at this point I was living at my current address) was sent to a PO Box that I only had in 2005 for 6 months (which I never EVER changed my address at USCIS to that, and no one "authorized" to do so would have done it as no one knew I had that but the post office)

Well the Biometrics Letter sent to my parent's address a month LATER. Then 2 weeks after the biometrics appt our "green cards" were mailed. Well My parents and sis were mailed to my parent's address yet mine was mailed to that PO Box.

Should I have to pay the $370 for a new one when they do not have any proof that anyone "authorized" changed my address to an OLD address that wasn't being used?

What can I do? This is just ridiculous!
 
just an update, i have called USCIS and placed a review request on this issue. i dont think it will make much of a difference, but they did provide me with a reference number.

i also made an infopass for first thing tomorrow morning to try and get the temp stamp on my passport. normally i get told no, i cant get it until i file the i-90 (or that it shows it was received in the system) but i'm hoping that by having this reference number of a request to review they may give me the temp stamp as they said it takes 30 days to review. -lm crossing my fingers and toes!

i dont think i'm asking for much. i just want the proof even a 30 day proof so that i can renew my licesne so that i may continue to work and to get insurance as they dont want to give anyone thats not legal any insurance.

i'm trying to use up all my possibilities i have before giving up. at least i know that if i pay the fee and file online i get instant proof of the i-90 filed and can get it then. but wow, that $380 is so expensive.

i also readt that they raised the price of the original green card application to almost a grand? i feel sorryfor anyone having to file with that, its more than twice what it used to be!

Bring the approval notice also.

More than a grand. It's now $1010 for the I-485 (although that price now includes EAD and Advance Parole, so it's not that terrible compared to the old fee).

You can't do anything, other than paying more than $370 to get a lawyer to fight them.
 
i'm taking every form i've gotten when i go. too much info is better than not enough.

and wow, thats so expensive! i guess over all the price isn't that much different as they added that too, but i think i'd be harder to pay it all up front then to have time to pay it seperate. guess it would depend on how much time you're wanting to wait.

and i have a feeling after all my efforts im a end up paying the fee. i hope by then i'll have that saved.
 
and as went to the immigration office tuesday morning, and as expected it got me no where. the officer refused to check when my address was changed to that po box so that i could prove them someone authirezed didnt change it. i found out my i-90 with fee waver was rejected yet my status online never changed. and like the other 2 i filed (as never received) they supposedly sent me a letter telling me why. well according to the officer they sent it o me dec 26th to my current address yet i never received it. and im the only one that checks the mail so i know for sure. i think they are lying. sure makes me feel great about trusting them with anything.

so all in all my last resort is to pay. luckly if i do it online my confirmation sheet is proof enough to get a temporary stamp. but coming up with the money is the issue.

i have tried reapplying for medicaid with my 'approval' letter as my proof of ins as they ask for. i wont find out if they will even accept it for a month or two. i have an appt at the dmv to renew my license today. i'm hoping they let me with that approval letter and all my other forms.

i really hope some day immigration can make things easier on everyone. at least they are getting somewhere with the option to do it online for instant verification.
 
well at the dmv they allowed me to get another temp card. this is the 3rd time. usually people pay $15-20 for a license that is good for 6-8 years, ive paid $60 in the last 3 years because they only give me a temp one.

at least i was able to renew it for another year.
