I was involved in a shoplifting in 1991 with another friend ( I was foolish and young, new to this country ). Was caught by the security of the store. There was a police report but no finger prints were taken nor was I arrested. We were told by the stores' security staff that if we pay fine(which we did),the case will dropped. But case was sent to the court and was dismissed as the store representatives did not show up at the hearing and apparently withdrew the case. I was never convicted. At the time of filing for I-485 I went to the court but they could not find any record of the case by computer search. I did check ' YES ' in the application where it says ' Have you ever been cited, charged. convicted etc. and wrote a brief explaination of the situation. Unfortunately I do not have any documentation of case dismissal or charges. Now,
1. What are the chances for denial?
2. What can I do at this point?
3. Is there any way to get court records showing no conviction and case dismissal as theres got to the record somewhere in
the court , may be a manual search is needed?

Anyone, please help with you advice, I will really appreciate any input. ( I have 3 little kids and my future is at stake )

A friend of mine was caught "relieving" in a public place. He had a case and he marked "YES" in I-485. They called him for an interview in the local INS office and approved his case. Minor offence and he had all court papers.

But the funny thing is that, the incident was not in any record (FBI or whatever) and he had to go through all this for his honesty. Since you checked "YES", your case will be transfered to the local office. After that, its upto you. Get all the documents ASAP, because,

another friend of mine (who checked YES), couldn't submit the right documents and his case was denied. He is under deportation hearings, after living here for 15 years. That's life...

thanks hillbilly,
do you have an idea how i can get required documents as court could not find them by a computer search under my name. i do not have the case # and don't even remember the exact date of the case. can an attorney be of any help?

I don't think you will have a problem (you may be called for an interview though). You were not convicted and you were honest on the I-485.

Thank you Jim,
